The Authority for Consumers and Markets shall ensure that its decisions contribute to the achievement of the objectives as referred to in Article 3(1), second subparagraph, and (2) and (4) of Directive (EU) 2018/1972.
In the performance of its tasks and the exercise of its powers, the Authority for Consumers and Markets shall take the utmost account of recommendations from the European Commission as referred to in Article 38(1) of Directive (EU) 2018/1972, and of opinions and common positions issued by BEREC, insofar as such recommendations, opinions and positions relate to the tasks assigned to or powers conferred upon the Authority for Consumers and Markets by or pursuant to this Act.
If the Authority for Consumers and Markets does not apply a recommendation of the European Commission as referred to in the second paragraph, it shall inform the European Commission and Our Minister, stating the reasons therefor.
De Autoriteit Consument en Markt draagt er zorg voor dat haar besluiten bijdragen aan het verwezenlijken van de doelstellingen als bedoeld in artikel 3, eerste lid, tweede alinea, en tweede en vierde lid, van richtlijn (EU) 2018/1972/.
De Autoriteit Consument en Markt houdt bij de uitoefening van haar taken en bevoegdheden zoveel mogelijk rekening met aanbevelingen van de Europese Commissie als bedoeld in artikel 38, eerste lid, van richtlijn (EU) 2018/1972, en met door BEREC gegeven adviezen en gemeenschappelijke standpunten, voor zover die aanbevelingen, adviezen en standpunten betrekking hebben op de bij of krachtens deze wet aan de Autoriteit Consument en Markt opgedragen taken of verleende bevoegdheden.
Indien de Autoriteit Consument en Markt geen toepassing geeft aan een aanbeveling van de Europese Commissie als bedoeld in het tweede lid, informeert zij, onder vermelding van de redenen, de Europese Commissie en Onze Minister.
