Our Minister may revoke the acquisition or granting of Netherlands nationality if it is based on a false statement or fraud provided by the person concerned, or on the concealment of any fact relevant to the acquisition or granting. The revocation shall have retroactive effect to the time of acquisition or granting of Netherlands nationality. The revocation is not possible if a period of twelve years has elapsed since the acquisition or granting. The third sentence shall not apply if the person concerned has been convicted of one of the crimes described in Articles 6, 7, 8, and 8 bis of the Rome Statute of the International Criminal Court, concluded at Rome on 17 July 1998 (Trb. 2000, 120 and Trb. 2011, 73).
Our Minister may revoke the Netherlands nationality of a person who has been irrevocably convicted of:
an offence described in Titles I to IV inclusive of the Second Book of the Dutch Penal Code, which according to the statutory description carries a term of imprisonment of eight years or more;
an offence as referred to in Articles 83, 134a or 205 of the Dutch Penal Code;
an offence similar to the offences referred to under (a) which, according to the legal definition in the criminal law of one of the countries of the Kingdom, is punishable by a term of imprisonment of eight years or more, or an offence which, according to the legal definition in the criminal law of one of the countries of the Kingdom, is similar to the offences referred to under (b);
an offence as described in Articles 6, 7, 8 and 8 bis of the Rome Statute of the International Criminal Court, done at Rome on 17 July 1998 (Trb. 2000, 120 and Trb. 2011, 73).
Our Minister may revoke the Netherlands citizenship of a person who has reached the age of sixteen and who voluntarily enters the foreign military service of a state that is involved in hostilities against the Kingdom or against an alliance of which the Kingdom is a member.
Our Minister may, in the interest of national security, revoke the Dutch nationality of a person who has attained the age of eighteen years and who is outside the Kingdom, if it appears from his conduct that he has joined an organisation which has been placed by Our Minister, in accordance with the view of the Council of Ministers of the Kingdom, on a list of organisations that participate in a national or international armed conflict and pose a threat to national security.
A person who has lost Dutch nationality on the basis of the second, third or fourth paragraph cannot regain Dutch nationality. We may, having heard the Council of State of the Kingdom, deviate from the first sentence in exceptional cases, provided that at least five years have elapsed since the loss of Dutch nationality.
Netherlands nationality is lost by a minor through the termination of the family law relationship from which it is derived pursuant to Article 3, 4, 5, 5a, 5b, 5c, or 6, paragraph 1, opening words and under (c), as well as pursuant to Article 4 as it read until the entry into force of the Kingdom Act amending the Kingdom Act on Netherlands Nationality regarding the acquisition, granting and loss of Netherlands nationality of 21 December 2000, Bulletin of Acts and Decrees (Stb.) 618 and pursuant to Article 5 as it read until the entry into force of the Kingdom Act of 3 July 2003 amending the Kingdom Act on Netherlands Nationality in connection with the establishment of the Conflict of Laws (Adoption) Act (Stb. 284). The loss referred to in the first sentence shall not occur if the other parent is a Netherlands national at the time of the termination of that relationship or was so at the time of his or her death. The loss shall likewise not occur if Netherlands nationality can also be derived from Article 3, paragraph 3, or from Article 2, under (a), of the Act of 12 December 1892 on Netherlands Nationality and Residency (Stb. 268).
Netherlands citizenship is not lost except by virtue of one of the provisions of this Chapter.
With the exception of the case referred to in the first paragraph, no loss of Netherlands nationality shall occur if the consequence thereof would be that the person concerned is not considered by any state, under its legislation, as its national.
The list referred to in the fourth paragraph shall, after adoption or amendment, be sent to the House of Representatives of the States General (Tweede Kamer der Staten-Generaal), to the States of Aruba, to those of Curaçao and to those of Sint Maarten and shall be published in the Government Gazette (Staatscourant), in the Official Gazette (Afkondigingsblad) of Aruba, in the Official Gazette (Publicatieblad) of Curaçao and in the Official Gazette (Afkondigingsblad) of Sint Maarten.
By or pursuant to an order in council of the Kingdom, further rules shall be established regarding the elements to be considered in the balancing of interests concerning a decision on the withdrawal of Netherlands citizenship on the basis of the first, second, third, or fourth paragraph.
Onze Minister kan de verkrijging of verlening van het Nederlanderschap intrekken, indien zij berust op een door de betrokken persoon gegeven valse verklaring of bedrog, dan wel op het verzwijgen van enig voor de verkrijging of verlening relevant feit. De intrekking werkt terug tot het tijdstip van verkrijging of verlening van het Nederlanderschap. De intrekking is niet mogelijk indien sedert de verkrijging of verlening een periode van twaalf jaar is verstreken. De derde volzin is niet van toepassing indien de betrokken persoon is veroordeeld voor een van de misdrijven, omschreven in de artikelen 6, 7, 8 en 8 bis van het op 17 juli 1998 te Rome tot stand gekomen Statuut van Rome inzake het Internationale Strafhof (Trb. 2000, 120 en Trb. 2011, 73).
Onze Minister kan het Nederlanderschap intrekken van de persoon die onherroepelijk is veroordeeld wegens:
een misdrijf omschreven in de titels I tot en met IV van het Tweede Boek van het Nederlandse Wetboek van Strafrecht, waarop naar de wettelijke omschrijving een gevangenisstraf van acht jaar of meer is gesteld;
een misdrijf als bedoeld in de artikelen 83, 134a of 205 van het Nederlandse Wetboek van Strafrecht;
een misdrijf dat soortgelijk is aan de misdrijven bedoeld onder a waarop naar de wettelijke omschrijving in de strafwet van een van de landen van het Koninkrijk een gevangenisstraf van acht jaar of meer is gesteld, danwel een misdrijf dat naar de wettelijke omschrijving in de strafwet van een van de landen van het Koninkrijk soortgelijk is aan de misdrijven bedoeld onder b;
een misdrijf omschreven in de artikelen 6, 7, 8 en 8 bis van het op 17 juli 1998 te Rome tot stand gekomen Statuut van Rome inzake het Internationale Strafhof (Trb. 2000, 120 en Trb. 2011, 73).
Onze Minister kan het Nederlanderschap intrekken van de persoon die de leeftijd van zestien jaar heeft bereikt en die zich vrijwillig in vreemde krijgsdienst begeeft van een staat die betrokken is bij gevechtshandelingen tegen het Koninkrijk dan wel tegen een bondgenootschap waarvan het Koninkrijk lid is.
Onze Minister kan in het belang van de nationale veiligheid het Nederlanderschap intrekken van een persoon die de leeftijd van achttien jaar heeft bereikt en die zich buiten het Koninkrijk bevindt, indien uit zijn gedragingen blijkt dat hij zich heeft aangesloten bij een organisatie die door Onze Minister, in overeenstemming met het gevoelen van de Rijksministerraad, is geplaatst op een lijst van organisaties die deelnemen aan een nationaal of internationaal gewapend conflict en een bedreiging vormen voor de nationale veiligheid.
De persoon die de Nederlandse nationaliteit heeft verloren op grond van het tweede, derde of vierde lid kan de Nederlandse nationaliteit niet herkrijgen. Wij kunnen, de Raad van State van het Koninkrijk gehoord, in bijzondere gevallen van de eerste zin afwijken, indien ten minste vijf jaren zijn verstreken sedert het verlies van de Nederlandse nationaliteit.
Het Nederlanderschap wordt door een minderjarige verloren door het vervallen van de familierechtelijke betrekking waaraan het wordt ontleend ingevolge artikel 3, 4, 5, 5a, 5b, 5c, of 6, eerste lid, aanhef en onder c, alsmede ingevolge artikel 4 zoals dit luidde tot de inwerkingtreding van de Rijkswet tot wijziging van de Rijkswet op het Nederlanderschap met betrekking tot de verkrijging, de verlening en het verlies van het Nederlanderschap van 21 december 2000, Stb. 618 en ingevolge artikel 5 zoals dat luidde tot de inwerkingtreding van de Rijkswet van 3 juli 2003 tot wijziging van de Rijkswet op het Nederlanderschap in verband met de totstandkoming van de Wet conflictenrecht adoptie (Stb. 284). Het verlies bedoeld in de eerste zin treedt niet in indien de andere ouder op het tijdstip van het vervallen van die betrekking Nederlander is of dat was ten tijde van zijn overlijden. Het verlies treedt evenmin in indien het Nederlanderschap ook kan worden ontleend aan artikel 3, derde lid, of aan artikel 2, onder a, van de Wet van 12 december 1892 op het Nederlanderschap en het ingezetenschap (Stb. 268).
Het Nederlanderschap wordt niet verloren dan krachtens een van de bepalingen van dit hoofdstuk.
Met uitzondering van het geval, bedoeld in het eerste lid, vindt geen verlies van het Nederlanderschap plaats indien het gevolg daarvan zou zijn dat betrokkene door geen enkele staat, krachtens diens wetgeving, als zijn onderdaan wordt beschouwd.
De in het vierde lid bedoelde lijst wordt na vaststelling of wijziging toegezonden aan de Tweede Kamer der Staten-Generaal, aan de Staten van Aruba, aan die van Curaçao en aan die van Sint Maarten en wordt gepubliceerd in de Staatscourant, in het Afkondigingsblad van Aruba, in het Publicatieblad van Curaçao en in het Afkondigingsblad van Sint Maarten.
Bij of krachtens algemene maatregel van rijksbestuur worden nadere regels gesteld omtrent de elementen die betrokken worden bij de belangenafweging inzake een beslissing omtrent intrekking van het Nederlanderschap op grond van het eerste, tweede, derde of vierde lid.

By decision of 23 February 2023, the State Secretary for Justice and Security revoked the Dutch nationality of [petitioner]. The petition seeks, by way of a provisional remedy, a determination that the legal consequences of the decision of 23 February 2023 and the decision of 30 August 2023 to revoke the Dutch nationality be suspended until the Division has decided on the appeal. Specifically, the petition thereby seeks that [petitioner] be treated as a Dutch national until the ruling on the appeal.
Decision on rechtspraak.nlBy decision of 18 November 2013, the State Secretary for Justice and Security revoked the Dutch nationality of [appellant sub 2]. By decision of 22 July 2020, the State Secretary again declared the objection lodged by [appellant sub 2] against that decision to be unfounded. [appellant sub 2] was born on [date of birth] 1949 in Rwanda. In 1997, he entered the Netherlands. On 7 October 1997, the Minister admitted [appellant sub 2] as a refugee and granted him a residence permit. By Royal Decree of 25 February 2003, [appellant sub 2] acquired Dutch nationality. The Minister revoked the Dutch nationality of [appellant sub 2] by decision of 18 November 2013 on the basis of Article 14, paragraph 1, of the Netherlands Nationality Act (Rijkswet op het Nederlanderschap), because [appellant sub 2] remained silent during the admission and naturalisation procedure regarding his role in the genocide in Rwanda in 1994. According to the Minister, [appellant sub 2] knew or at least could reasonably have suspected that this information was relevant for the assessment of his petition for the grant of Dutch nationality.
Decision on rechtspraak.nlBy decision of 24 August 2020, the State Secretary for Justice and Security ordered the person concerned to leave the European Union immediately and issued an entry ban against him. The person concerned was born in the Netherlands on [date of birth] 1993. At that time, he acquired Turkish nationality through his parents. On 17 January 1995, he acquired Dutch nationality together with his father. He retained his Turkish nationality at that time.
Decision on rechtspraak.nlBy decision of 24 August 2020, the State Secretary for Justice revoked the Dutch nationality of [appellant]. [appellant] was born in the Netherlands on [date of birth]. At that time, he acquired Turkish nationality through his parents. On 17 January 1995, he acquired Dutch nationality together with his father. He retained his Turkish nationality at that time. The State Secretary revoked the Dutch nationality of [appellant] pursuant to Article 14, paragraph 2, opening words and under (b), of the Kingdom Act on Dutch Nationality, because he has been irrevocably convicted of a terrorist offence as referred to in Article 83 and Article 134a of the Criminal Code. The State Secretary refers in this regard to the judgment of the Court of Appeal of The Hague of 18 April 2018, ECLI:NL:GHDHA:2018:815. It appears from that judgment that the Court of Appeal convicted [appellant] for a single act constituting multiple offences (eendaadse samenloop) of intentionally providing oneself with information and acquiring knowledge for the purpose of committing a terrorist offence and of planning a terrorist attack in the Netherlands.
Decision on rechtspraak.nlBy letter of 6 April 2023, the State Secretary for Justice and Security informed [appellant] that he would not grant his petition to stay the decision-making process regarding the withdrawal of his Dutch nationality. The State Secretary informed [appellant] on 18 January 2023 of his intention to withdraw his Dutch nationality. The reason for this is that [appellant] has been irrevocably convicted of a terrorist offence as referred to in Article 83 of the Criminal Code. It follows from Article 14, paragraph 2, opening words and under (b), of the Kingdom Act on Dutch Nationality (Rijkswet op het Nederlanderschap) that the State Secretary may withdraw the Dutch nationality in such a case. However, the State Secretary cannot withdraw the Dutch nationality if this leads to the statelessness of the person concerned. This follows from Article 14, paragraph 8, of the RWN. In his views and in an e-mail of 28 March 2023, [appellant] petitioned the State Secretary to stay the decision-making process regarding the withdrawal of the Dutch nationality.
