An arbitration agreement providing that arbitration is to take place outside the Netherlands shall not prevent a party from petitioning the ordinary court to appoint a supervisory judge (rechter-commissaris) if a witness who resides or actually stays in the Netherlands does not appear voluntarily. In such case, the provisions of Article 1041a, paragraphs 1 to 3 inclusive, shall apply mutatis mutandis.
Een overeenkomst tot arbitrage waaruit voortvloeit dat arbitrage buiten Nederland moet plaatsvinden, belet niet dat een partij de gewone rechter verzoekt een rechter-commissaris te benoemen indien een getuige die in Nederland woont of feitelijk verblijf houdt, niet vrijwillig verschijnt. In dat geval zijn de bepalingen van artikel 1041a, eerste tot en met derde lid, van overeenkomstige toepassing.
