If the petition is filed by one of the spouses while the other spouse, on the grounds of a mental disorder, resides in a hospital, nursing home, care facility, or a psychiatric institution as referred to in the third paragraph, the petition shall state the fact of this residence.
In the case referred to in the first paragraph, the court shall recommend the board of the legal aid board to assign a lawyer to this spouse if he does not yet have a lawyer and shall also determine a new period for the submission of a statement of defence. Rules shall be established by administrative order (algemene maatregel van bestuur) for the remuneration that the lawyer receives for the legal aid provided by him.
A psychiatric institution is understood to mean an accommodation as referred to in Article 1:1, paragraph (b), of the Compulsory Mental Health Care Act (Wet verplichte geestelijke gezondheidszorg), or as referred to in Article 1, paragraph 1, paragraph (b), of the Care and Coercion (Psychogeriatric and Intellectually Disabled Clients) Act (Wet zorg en dwang psychogeriatrische en verstandelijk gehandicapte cliënten).
Betreft het een verzoek van een der echtgenoten, terwijl de andere echtgenoot op grond van een geestesstoornis verblijft in een ziekenhuis, verpleeghuis, verpleeginrichting of een psychiatrische inrichting als bedoeld in het derde lid, dan vermeldt het verzoekschrift het feit van dit verblijf.
In het geval bedoeld in het eerste lid beveelt de rechter het bestuur van de raad voor rechtsbijstand aan deze echtgenoot een advocaat toe te voegen indien hij nog geen advocaat heeft en bepaalt hij tevens een nieuwe termijn voor het indienen van een verweerschrift. Bij algemene maatregel van bestuur worden regels gesteld voor de vergoeding die de advocaat ontvangt voor de door hem verleende rechtsbijstand.
Onder een psychiatrische inrichting wordt verstaan een accommodatie als bedoeld in artikel 1:1, onderdeel b, van de Wet verplichte geestelijke gezondheidszorg, of als bedoeld in artikel 1, eerste lid, onderdeel b, van de Wet zorg en dwang psychogeriatrische en verstandelijk gehandicapte cliënten.
