If the defendant has a known domicile or a known actual residence outside the Netherlands in a State where the regulation referred to in Article 56, paragraph 1, is applicable, or in a State located in Europe which is a party to the Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, concluded at The Hague on 15 November 1965 (Trb. 1966, 91), the period for the summons shall be at least four weeks.
If the defendant has no known domicile or known actual residence in the Netherlands, nor in a State as referred to in the first paragraph, the period for the summons shall be at least three months.
If the defendant has no known place of residence or known actual place of stay in the Netherlands, the period for the summons shall, in deviation from the first and second paragraphs, be at least one week, provided that the writ is served in the Netherlands on the defendant in person, or at a place of residence chosen by the defendant for the purpose of this case.
Indien de gedaagde een bekende woonplaats of een bekend werkelijk verblijf buiten Nederland heeft in een Staat waar de in artikel 56, eerste lid, bedoelde verordening van toepassing is, of in een Staat die in Europa is gelegen en die partij is bij het op 15 november 1965 te 's-Gravenhage tot stand gekomen Verdrag inzake de betekening en de kennisgeving in het buitenland van gerechtelijke en buitengerechtelijke stukken in burgerlijke en in handelszaken (Trb. 1966, 91), is de termijn van dagvaarding ten minste vier weken.
Indien de gedaagde noch in Nederland, noch in een Staat als bedoeld in het eerste lid, een bekende woonplaats of een bekend werkelijk verblijf heeft, is de termijn van dagvaarding ten minste drie maanden.
Indien de gedaagde in Nederland geen bekende woonplaats of bekend werkelijk verblijf heeft, is de termijn van dagvaarding in afwijking van het eerste en tweede lid ten minste een week, indien het exploot in Nederland wordt gedaan aan de gedaagde in persoon, dan wel aan een door de gedaagde voor deze zaak gekozen woonplaats.
