If the court on appeal sets aside a judgment or order of a lower court, whereby the latter had declared itself incompetent due to a lack of jurisdiction or in connection with an arbitration agreement, the court shall refer the case back to that lower court for a decision on the merits, unless the parties declare their desire for the court on appeal to retain the case.
Indien de rechter in hoger beroep een vonnis of beschikking van een lagere rechter, waarbij deze zich onbevoegd had verklaard wegens ontbreken van rechtsmacht of in verband met een overeenkomst tot arbitrage, vernietigt, verwijst de rechter de zaak naar deze lagere rechter om op de hoofdzaak te worden beslist, tenzij partijen verklaren te verlangen dat de rechter in beroep de zaak aan zich houdt.
