If a case, being heard by the sub-district court (kantonrechter), must be further heard and decided by a chamber for cases other than sub-district cases, the case shall be referred to such a chamber for that purpose at the request of one of the parties or of the court's own motion (ambtshalve).

If a case, being dealt with by a chamber for matters other than cantonal matters, must be further dealt with and decided by the cantonal judge, the case shall, at the request of one of the parties or of the court's own motion, be referred for that purpose to a chamber for cantonal matters.

The question of whether a referral is necessary shall be assessed by the court, insofar as the subject matter of the dispute is decisive therefor, on the basis of its provisional judgment on the subject matter of the dispute.

In the decision for referral, the court shall state the manner in which the parties must appear in the proceedings and, insofar as applicable, the court fee or the increased court fee levied from the parties pursuant to Article 8 of the Civil Cases Court Fees Act (Wet griffierechten burgerlijke zaken) and the period within which this court fee or this increased court fee must be paid. Article 111, paragraph 2, opening words and subparagraphs (k) and (l), shall apply mutatis mutandis. In the case of writ of summons proceedings, the court shall also state a new docket date (roldatum) and, if default has been entered against the defendant, shall order that the plaintiff notify the defendant thereof by formal notice (exploot), accompanied by service of the decision for referral.

No remedy shall lie against a referral or against the failure to make a referral. The court to which the case has been referred is bound by the referral.

De vraag of verwijzing nodig is beoordeelt de rechter, voor zover daarvoor het onderwerp van het geschil bepalend is, aan de hand van zijn voorlopig oordeel over het onderwerp van het geschil.

In de beslissing tot verwijzing vermeldt de rechter op welke wijze partijen in de procedure moeten verschijnen en, voor zover van toepassing, het griffierecht of het verhoogde griffierecht dat ingevolge artikel 8 van de Wet griffierechten burgerlijke zaken van partijen wordt geheven en binnen welke termijn dit griffierecht of dit verhoogde griffierecht betaald dient te worden. Artikel 111, tweede lid, aanhef en onderdeel k en onderdeel l, is van overeenkomstige toepassing. In het geval van een dagvaardingsprocedure vermeldt de rechter tevens een nieuwe roldatum en beveelt hij, indien tegen de gedaagde verstek is verleend, dat deze door de eiser bij exploot aan de gedaagde wordt aangezegd onder betekening van de beslissing tot verwijzing.

Tegen een verwijzing en tegen het achterwege laten van verwijzing staat geen voorziening open. De rechter naar wie de zaak is verwezen, is aan de verwijzing gebonden.
