For the maintenance of a patent, an amount to be determined by or pursuant to an Order in Council must be paid to the office each year, for the first time before the commencement of the fourth year after the date of filing referred to in Article 29, paragraph 1, on the last day of the month in which the application that led to the patent was filed, or is deemed to have been filed pursuant to Article 28, paragraph 1.
For the maintenance of a European patent, an amount as referred to in the first paragraph must be paid to the Office each year, for the first time after the expiry of the year referred to in Article 86(4) of the European Patent Convention, but not earlier than the commencement of the fourth year following the date of filing referred to in Article 80 of the European Patent Convention, on the last day of the month in which falls the date of filing which the European patent application that led to the patent possesses pursuant to Article 80 of the European Patent Convention, with due observance of Articles 61 or 76 of that Convention. If the amount due for the first time would have to be paid within a period of two months after the day on which the mention of the grant of the European patent is published in accordance with Article 97(4) of the European Patent Convention, this amount may still be paid on the last day of the month in which this period expires.
In the event of payment after the due date, increases to be determined by or pursuant to an Order in Council shall be due.
Voor de instandhouding van een octrooi moet elk jaar, voor het eerst voor de aanvang van het vierde jaar na de in artikel 29, eerste lid, bedoelde datum van indiening, op de laatste dag van de maand waarin de aanvrage die tot octrooi heeft geleid is ingediend, of ingevolge artikel 28, eerste lid, wordt aangemerkt te zijn ingediend, aan het bureau een bij of krachtens algemene maatregel van rijksbestuur vast te stellen bedrag worden betaald.
Voor de instandhouding van een Europees octrooi moet elk jaar, voor het eerst na afloop van het in artikel 86, vierde lid, van het Europees Octrooiverdrag bedoelde jaar doch niet eerder dan voor de aanvang van het vierde jaar na de in artikel 80 van het Europees Octrooiverdrag bedoelde datum van indiening, aan het bureau een bedrag als in het eerste lid bedoeld worden betaald en wel op de laatste dag van de maand waarin de datum van indiening valt, die de Europese octrooiaanvrage, die tot het octrooi heeft geleid, ingevolge artikel 80 van het Europees Octrooiverdrag met inachtneming van de artikelen 61 of 76 van dat verdrag, bezit. Indien het voor de eerste maal verschuldigde bedrag zou moeten worden betaald binnen een termijn van twee maanden na de dag waarop overeenkomstig artikel 97, vierde lid, van het Europees Octrooiverdrag de vermelding van de verlening van het Europees octrooi is gepubliceerd, kan dit bedrag nog worden betaald op de laatste dag van de maand waarin deze termijn eindigt.
Bij betaling na de vervaldag zijn bij of krachtens algemene maatregel van rijksbestuur vast te stellen verhogingen verschuldigd.
