Without prejudice to Article 56, paragraph 2, first sentence, a licence is created by:
a decision of the Arbitration Committee, as referred to in Article 20 of the Treaty establishing the European Atomic Energy Community (Euratom) (Trb. 1957, 92);
a decision of Our Minister for the implementation of Article 21 of the aforementioned treaty.
With regard to a licence arising from a final decision as referred to in paragraph 1, under (a), Article 56, paragraph 2, second and third sentences, shall apply mutatis mutandis.
With regard to a decision as referred to in the first paragraph, under (b), Article 58, first, fourth and fifth paragraphs, first, second and third sentences, shall apply mutatis mutandis. With regard to a licence created by such a decision, Article 58, fifth paragraph, fourth sentence, and sixth paragraph, shall apply mutatis mutandis.
A licence as referred to in the first paragraph does not apply to Curaçao and Sint Maarten.
Onverminderd artikel 56, tweede lid, eerste volzin, ontstaat een licentie door:
een uitspraak van de Arbitrage-Commissie, bedoeld in artikel 20 van het Verdrag tot oprichting van de Europese Gemeenschap voor Atoomenergie (Euratom) (Trb. 1957, 92);
een besluit van Onze Minister ter uitvoering van artikel 21 van genoemd verdrag.
Ten aanzien van een licentie, ontstaan door een eindbeslissing als bedoeld in het eerste lid, onder a, is artikel 56, tweede lid, tweede en derde volzin, van overeenkomstige toepassing.
Ten aanzien van een besluit als bedoeld in het eerste lid, onder b, is artikel 58, eerste, vierde en vijfde lid, eerste, tweede en derde volzin, van overeenkomstige toepassing. Ten aanzien van een door zodanig besluit ontstane licentie is artikel 58, vijfde lid, vierde volzin, en zesde lid, van overeenkomstige toepassing.
Een licentie als bedoeld in het eerste lid geldt niet voor Curaçao en Sint Maarten.
