Article 52a

The Office shall, upon the petition of the person to whom a European patent has been granted, restore the situation referred to in Article 49, paragraph 1, or the situation prior to the lapse of the patent referred to in Article 62, respectively, if:
an application for registration as referred to in Article 51a, paragraph 1, which has been submitted within the time limit referred to in Article 9, paragraph 1, point (g), of Regulation (EU) No 1257/2012 of the European Parliament and of the Council of 17 December 2012 implementing enhanced cooperation in the area of the creation of unitary patent protection (OJ EU 2012, L 361), has been refused;
Article 52, paragraph 4, or Article 62 is applicable, and
the conditions mentioned in this article have been met.
The petition shall be filed within two months after the date of:
the decision to refuse, as referred to in the first paragraph, or
the decision of the Court of First Instance or the Court of Appeal of the Unified Patent Court by which the decision to refuse is upheld.
Simultaneously with the petition, the petitioner shall submit a copy of the decision or the ruling referred to in the second paragraph, point (a) or (b).
If Article 52, paragraph 4, is applicable:
if the petitioner, upon submission of the petition, performs the acts referred to in Article 52, paragraph 1, whereby the remaining paragraphs of Article 52 apply mutatis mutandis, and
If the petitioner pays the amount due pursuant to Article 61, paragraph 2, within four weeks after the dispatch of a notification by the office of the amount due, provided that on the day of dispatch of this notification the time limit referred to in Article 61, paragraph 2, has expired.
If Article 62 applies, the petitioner shall pay the amount due under Article 61, paragraph 2, within four weeks after the dispatch of the notification of the amount due by the office.
The office shall record the restoration, as referred to in the first paragraph, in the patent register.
Het bureau herstelt, op verzoek van degene aan wie een Europees octrooi is verleend, de toestand, bedoeld in artikel 49, eerste lid, respectievelijk de toestand voorafgaand aan het verval van het octrooi, bedoeld in artikel 62, indien:
zijn aanvraag tot een registratie als bedoeld in artikel 51a, eerste lid, die binnen de termijn, genoemd in artikel 9, eerste lid, onderdeel g, van verordening (EU) nr. 1257/2012 van het Europees Parlement en de Raad van 17 december 2012 tot het uitvoering geven aan nauwere samenwerking op het gebied van de instelling van eenheidsoctrooibescherming (PbEU 2012, L 361) is ingediend, is geweigerd;
artikel 52, vierde lid, of artikel 62 van toepassing is, en
voldaan is aan de voorwaarden, genoemd in dit artikel.
Het verzoek wordt ingediend binnen twee maanden na dagtekening van:
het besluit tot weigering, bedoeld in het eerste lid, of
de beslissing van het Gerecht van Eerste Aanleg of het Hof van Beroep van het Eengemaakt Octrooigerecht waarbij het besluit tot weigering in stand is gelaten.
Gelijktijdig met het verzoek overlegt de verzoeker een afschrift van het besluit of de beslissing, bedoeld in het tweede lid, onderdeel a of b.
Indien artikel 52, vierde lid, van toepassing is:
verricht de verzoeker bij indiening van het verzoek alsnog de in artikel 52, eerste lid, bedoelde handelingen, waarbij de overige leden van artikel 52 van overeenkomstige toepassing zijn, en
voldoet de verzoeker het ingevolge artikel 61, tweede lid, verschuldigde bedrag binnen vier weken na verzending van een mededeling door het bureau van het verschuldigde bedrag, indien op de dag van verzending van deze mededeling de termijn, bedoeld in artikel 61, tweede lid, is verstreken.
Indien artikel 62 van toepassing is, voldoet de verzoeker het in artikel 61, tweede lid, verschuldigde bedrag binnen vier weken na verzending van de mededeling door het bureau van het verschuldigde bedrag.
Het bureau tekent het herstel, bedoeld in het eerste lid, in het octrooiregister aan.
