A European patent application, the content of which the applicant knows or should reasonably suspect must remain secret in the interest of the defence of the Kingdom or its allies, must be filed with the Office.
The office shall without delay send a copy of the description and drawings belonging to the application to Our Minister of Defence.
No later than three weeks before a European patent application must be forwarded to the European Patent Office, Our aforementioned Minister shall notify the Office whether the content of the application must remain secret in the interest of the defence of the Kingdom or its allies.
If a notification pursuant to the third paragraph has been made in the negative or if a notification has not been made, the Office shall forward the European patent application to the European Patent Office, as referred to in that Convention, in compliance with the time limit applicable thereto under the European Patent Convention.
The office shall notify the applicant without delay of any publication pursuant to the third paragraph or of the failure thereof.
Een Europese octrooiaanvrage, waarvan de inhoud - naar de aanvrager weet of redelijkerwijs moet vermoeden - in het belang van de verdediging van het Koninkrijk of zijn bondgenoten geheim moet blijven, moet worden ingediend bij het bureau.
Het bureau zendt onverwijld afschrift van de tot de aanvrage behorende beschrijving en tekeningen aan Onze Minister van Defensie.
Uiterlijk drie weken voordat een Europese octrooiaanvraag moet worden doorgezonden naar het Europees Octrooibureau, maakt Onze genoemde minister aan het bureau bekend of de inhoud van de aanvrage in het belang van de verdediging van het Koninkrijk of zijn bondgenoten geheim moet blijven.
Indien een bekendmaking krachtens het derde lid in ontkennende zin is gedaan of indien een bekendmaking is uitgebleven, zendt het bureau de Europese octrooiaanvrage, met inachtneming van de hiervoor krachtens het Europees Octrooiverdrag geldende termijn, door aan het Europees Octrooibureau, bedoeld in dat verdrag.
Het bureau geeft van enige bekendmaking krachtens het derde lid of van het uitblijven daarvan onverwijld kennis aan de aanvrager.
