The head of the institution for the nursing of persons placed at the disposal of the government (ter beschikking gestelden) shall provide the person placed at the disposal of the government or otherwise nursed with the opportunity to leave the institution for the nursing of persons placed at the disposal of the government in order to attend a judicial proceeding:
if he is obliged by virtue of a statutory provision to appear before a court or an administrative body;
if he is to stand trial for a criminal offence;
if he has a significant interest in attending the proceedings and there is no overriding objection to him leaving the institution for this purpose.
The head of the institution for the nursing of persons placed under a hospital order (ter beschikking gestelden) may determine that supervision shall be exercised during the stay outside the institution.
Het hoofd van de inrichting voor verpleging van ter beschikking gestelden stelt de ter beschikking gestelde of anderszins verpleegde in de gelegenheid de inrichting voor verpleging van ter beschikking gestelden te verlaten teneinde een gerechtelijke procedure bij te wonen:
indien hij krachtens wettelijk voorschrift verplicht is voor een rechter of bestuursorgaan te verschijnen;
indien hij ter zake van een misdrijf moet terecht staan;
indien hij bij het bijwonen van de procedure een aanmerkelijk belang heeft en tegen het verlaten van de inrichting hiertoe geen overwegend bezwaar bestaat.
Het hoofd van de inrichting voor verpleging van ter beschikking gestelden kan bepalen dat gedurende het verblijf buiten de inrichting toezicht wordt uitgeoefend.
