The perspective plan covers a period of four months, or such shorter period as the remainder of the sentence or the stay in the institution may be.
The juvenile has the right to a periodic evaluation of the perspective plan by the director. This evaluation shall take place at least three times per year, but in any event in a timely manner prior to the drafting of an advice as referred to in Article 77t, paragraph 5, of the Criminal Code or an extension as referred to in Article 265c, paragraph 1, or 305, paragraph 3, of Book 1 of the Civil Code.
The evaluation of the perspective plan shall take place on the basis of information from at least the official and the certified institution referred to in Article 25, paragraph 4. The juvenile shall be given the opportunity to express his views on the course of the stay in the institution. Furthermore, the parents or guardian, stepparent or foster parents of the juvenile shall be involved in the evaluation, with due observance of Article 25, paragraph 5, as well as the certified institution involved. A report of the evaluation shall be drawn up.
The following aspects shall be included in the evaluation:
residence in the group;
the achievement of the set objectives and the necessity to amend the objectives;
the changes in the clinical picture of the minor in the context of the treatment;
freedom of movement within and outside the institution;
significant incidents in which the minor has been involved;
the necessity of extending the stay in the institution.
Het perspectiefplan bestrijkt een periode van vier maanden, of zoveel korter als het strafrestant of het verblijf in de inrichting is, of zoveel korter als het strafrestant of het verblijf in de inrichting is.
De jeugdige heeft recht op een periodieke evaluatie door de directeur van het perspectiefplan. Deze evaluatie vindt ten minste driemaal per jaar plaats, doch in ieder geval tijdig voor de opmaking van een advies als bedoeld in artikel 77t, vijfde lid, van het Wetboek van Strafrecht of een verlenging als bedoeld in artikel 265c, eerste lid, of 305, derde lid, van Boek 1 van het Burgerlijk Wetboek.
De evaluatie van het perspectiefplan vindt plaats op basis van informatie van ten minste de functionaris en de gecertificeerde instelling, bedoeld in artikel 25, vierde lid. De jeugdige wordt in de gelegenheid gesteld zijn visie te geven op het verloop van het verblijf in de inrichting. Tevens worden bij de evaluatie betrokken de ouders of voogd, stiefouder of pleegouders van de jeugdige, met inachtneming van artikel 25, vijfde lid, en de betrokken gecertificeerde instelling. Van de evaluatie wordt een verslag opgesteld.
Bij de evaluatie worden de volgende aspecten betrokken:
het verblijf in de groep;
het bereiken van de gestelde doelen en de noodzaak tot wijziging van de doelen;
de veranderingen in het toestandsbeeld van de jeugdige in het kader van de behandeling;
de bewegingsvrijheid binnen en buiten de inrichting;
belangrijke voorvallen waarbij de jeugdige betrokken is geweest;
de noodzaak van verlenging van het verblijf in de inrichting.
