The accountability body, the stakeholder body or the supervisory board may submit a petition in the context of the right of inquiry, as referred to in Section 2 of Title 8 of Book 2 of the Civil Code (Burgerlijk Wetboek), to the Enterprise Chamber of the Amsterdam Court of Appeal.
Articles 346 to 359 inclusive of Book 2 of the Civil Code shall apply mutatis mutandis.
The costs associated with the filing of the petition referred to in the first paragraph shall be borne by the pension fund if they are reasonably necessary for the performance of the duties of the accountability body, the stakeholder body, or the supervisory board, and the pension fund has been notified in advance of the costs to be incurred.
Het verantwoordingsorgaan, het belanghebbendenorgaan of de raad van toezicht kan een verzoek in het kader van het recht van enquête, bedoeld in afdeling 2 van titel 8 van Boek 2 van het Burgerlijk Wetboek, indienen bij de ondernemingskamer van het gerechtshof Amsterdam.
De artikelen 346 tot en met 359 van Boek 2 van het Burgerlijk Wetboek zijn van overeenkomstige toepassing.
De kosten die verband houden met het indienen van het in het eerste lid bedoelde verzoek komen ten laste van het pensioenfonds indien zij redelijkerwijs noodzakelijk zijn voor de vervulling van de taak van het verantwoordingsorgaan, het belanghebbendenorgaan of de raad van toezicht en het pensioenfonds van de te maken kosten vooraf in kennis is gesteld.
