The house rules may stipulate that the possession of certain types of objects within the institution or a specific department thereof is prohibited, if this is necessary in the interest of maintaining order or safety within the institution, or for the limitation of the director's liability for the objects.

The director may grant a detainee permission to keep objects belonging to him, the possession of which is not prohibited pursuant to the first paragraph, in his living quarters or to have them in his possession, insofar as this is compatible with the following interests:

a.

the maintenance of order or security within the institution;

b.

the liability of the director for the objects.

The director may attach conditions to the consent referred to in the second paragraph, which may concern the use of and liability for these objects. Rules may be established by or pursuant to an order in council under which the liability of the director for objects that a detainee has in their possession pursuant to the second paragraph is limited to a certain amount.

The director is authorised to have objects belonging to the detainee examined at the latter's expense, in order to determine whether their admission or possession may be permitted or is prohibited, pursuant to the first and second paragraphs, respectively.

The director is authorised to seize objects for which no permission has been granted or which are prohibited, pursuant to the first and second paragraphs, respectively. He shall ensure that these objects are either stored at the expense of the detainee against issuance of a receipt for the benefit of the detainee, or sent at the detainee's expense to the sender or to an address provided by the detainee, or destroyed with the detainee's consent, or handed over to an investigative officer with a view to the prevention or detection of criminal offences.

In de huisregels kan worden bepaald dat het bezit van bepaalde soorten voorwerpen binnen de inrichting of een bepaalde afdeling daarvan verboden is, indien dit noodzakelijk is in het belang van de handhaving van de orde of de veiligheid in de inrichting, dan wel de beperking van de aansprakelijkheid van de directeur voor de voorwerpen.

De directeur kan een gedetineerde toestemming geven hem toebehorende voorwerpen, waarvan het bezit niet is verboden ingevolge het eerste lid, in zijn verblijfsruimte te plaatsen dan wel bij zich te hebben voor zover dit zich verdraagt met de volgende belangen:

a.

de handhaving van de orde of de veiligheid in de inrichting;

b.

de aansprakelijkheid van de directeur voor de voorwerpen.

De directeur kan aan de toestemming, bedoeld in het tweede lid, voorwaarden verbinden die kunnen betreffen het gebruik van en de aansprakelijkheid voor deze voorwerpen. Bij of krachtens algemene maatregel van bestuur kunnen regels worden gesteld krachtens welke de aansprakelijkheid van de directeur voor voorwerpen die een gedetineerde ingevolge het tweede lid onder zich heeft wordt beperkt tot een bepaald bedrag.

De directeur is bevoegd aan de gedetineerde toebehorende voorwerpen voor diens rekening te laten onderzoeken, teneinde vast te stellen of de toelating of het bezit daarvan kan worden toegestaan dan wel is verboden, ingevolge het eerste onderscheidenlijk het tweede lid.

De directeur is bevoegd voorwerpen ten aanzien waarvan geen toestemming is verleend dan wel die zijn verboden, ingevolge het eerste onderscheidenlijk het tweede lid, in beslag te nemen. Hij draagt zorg dat deze voorwerpen hetzij onder afgifte van een bewijs van ontvangst ten behoeve van de gedetineerde op diens kosten worden bewaard, hetzij voor diens rekening worden gezonden aan de verzender of een door de gedetineerde op te geven adres, hetzij met toestemming van de gedetineerde worden vernietigd, hetzij aan een opsporingsambtenaar ter hand worden gesteld met het oog op de voorkoming of opsporing van strafbare feiten.
