1.

In or attached to a European arrest warrant, the issuing examining magistrate (rechter-commissaris) must declare:

a.

if the requested person is a national of the executing Member State, that, provided he is sentenced to an unconditional custodial sentence in the Netherlands in respect of the facts for which the surrender may be granted, he shall be permitted to serve such sentence in the executing Member State;

b.

if the criminal offence upon which the European arrest warrant is based is punishable by a life imprisonment, the possibility exists, where appropriate, under Netherlands law for the application of a pardon to the imposed sentence or measure.

2.

Every person or authority in the Netherlands charged with a public task is bound by a declaration as referred to in the first paragraph.

Bij of in een Europees aanhoudingsbevel dient door de uitvaardigende rechter-commissaris te worden verklaard:

a.

indien de opgeëiste persoon een onderdaan is van de uitvoerende lidstaat, dat, zo hij ter zake van de feiten waarvoor de overlevering kan worden toegestaan in Nederland tot een onvoorwaardelijke vrijheidsstraf wordt veroordeeld, hij deze straf in de uitvoerende lidstaat zal mogen ondergaan;

b.

indien het strafbare feit dat aan het Europees aanhoudingsbevel ten grondslag ligt, is bedreigd met een levenslange vrijheidsstraf dat, in voorkomend geval, naar Nederlands recht de mogelijkheid bestaat van de toepassing van gratie op de opgelegde straf of maatregel.

Aan een verklaring, bedoeld in het eerste lid, is iedere persoon of instantie die in Nederland is belast met een publieke taak, gebonden.
