In the event of the application of Article 40, paragraph 1, the public prosecutor shall, after consultation with the competent foreign authorities, determine without delay the time and place at which the actual surrender shall take place.
The public prosecutor may, if necessary, with a view to the actual surrender pursuant to this section, order the arrest of the requested person for a maximum of three days. If the actual surrender could not take place within the period of three days, the order for arrest may be extended once by the public prosecutor for a maximum of three days. Article 37, paragraphs 2 and 3, shall apply mutatis mutandis.
In geval van toepassing van artikel 40, eerste lid, bepaalt de officier van justitie, na overleg met de bevoegde buitenlandse autoriteiten, onverwijld de tijd en de plaats waarop de feitelijke overlevering zal geschieden.
De officier van justitie kan, zo nodig, met het oog op de feitelijke overlevering krachtens deze paragraaf, de aanhouding van de opgeëiste persoon bevelen voor ten hoogste drie dagen. Indien de feitelijke overlevering niet binnen de termijn van drie dagen heeft kunnen plaatsvinden, kan het bevel tot aanhouding door de officier van justitie eenmaal voor ten hoogste drie dagen worden verlengd. Artikel 37, tweede en derde lid, is van overeenkomstige toepassing.
