If a European arrest warrant has not been transmitted to the public prosecutor, it shall be transmitted to him without delay.
A European arrest warrant may only be processed if it complies with the requirements set out in Article 2.
If, in the opinion of the public prosecutor, a European arrest warrant does not satisfy the requirements described in Article 2, he shall offer the issuing judicial authority the opportunity for completion or rectification.
If, in the opinion of the public prosecutor or in the opinion of the court, additional information is necessary in addition to the European arrest warrant, in particular in connection with Articles 7 up to and including 9 and 11 up to and including 13, the public prosecutor shall provide the issuing judicial authority with the opportunity to complete or amend it, taking into account the time limits referred to in Article 22.
Een Europees aanhoudingsbevel wordt, zo het niet aan de officier van justitie is toegezonden, onverwijld aan hem doorgezonden.
Een Europees aanhoudingsbevel kan slechts in behandeling worden genomen, indien het voldoet aan de vereisten omschreven in artikel 2.
Indien een Europees aanhoudingsbevel naar het oordeel van de officier van justitie niet voldoet aan de eisen omschreven in artikel 2 biedt hij de uitvaardigende justitiële autoriteit de gelegenheid tot completering of verbetering.
Indien naar het oordeel van de officier van justitie, dan wel naar het oordeel van de rechtbank naast het Europees aanhoudingsbevel aanvullende gegevens noodzakelijk zijn, met name in verband met de artikelen 7 tot en met 9 en 11 tot en met 13, stelt de officier van justitie de uitvaardigende justitiële autoriteit in de gelegenheid tot completering of verbetering, rekening houdend met de in artikel 22 genoemde termijnen.
