He who acts in violation of:

a.

a prohibition as referred to in Article 2, a prohibition as referred to in Article 3b, paragraph 1, or a prohibition as referred to in Article 4, paragraph 3;

b.

a regulation issued pursuant to Article 3c, paragraph 2, or Article 4, paragraph 1 or 2;

c.

a condition attached to an exemption pursuant to Article 8a, paragraph 1;

shall be punished by detention for a term not exceeding six months or a fine of the fourth category.

2.

Any person who intentionally acts in violation of the prohibition set forth in Article 3b, paragraph 1, or in Article 4, paragraph 3, shall be punished by a term of imprisonment not exceeding four years or a fine of the fifth category.

3.

Any person who intentionally acts in violation of the prohibition set forth in Article 2, under C, shall be punished by a term of imprisonment not exceeding six years or a fine of the fifth category.

4.

Any person who intentionally acts in violation of the prohibition set forth in Article 2, under B or D, shall be punished by a term of imprisonment not exceeding eight years or a fine of the fifth category.

5.

Any person who intentionally acts in violation of a prohibition set forth in Article 2, under A, shall be punished by a term of imprisonment not exceeding twelve years or a fine of the fifth category.

6.

If the act referred to in the second, third or fifth paragraph, respectively, concerns a small quantity intended for personal use, a term of imprisonment not exceeding one year or a fine of the third category shall be imposed.

Hij die handelt in strijd met:

a.

een in artikel 2, het in artikel 3b, eerste lid, of een in artikel 4, derde lid, gegeven verbod;

b.

een krachtens artikel 3c, tweede lid, of artikel 4, eerste of tweede lid, gegeven voorschrift;

c.

een krachtens artikel 8a, eerste lid, aan een ontheffing verbonden voorschrift;

wordt gestraft met hechtenis van ten hoogste zes maanden of geldboete van de vierde categorie.

2.

Hij die opzettelijk handelt in strijd met het in artikel 3b, eerste lid, of het in artikel 4, derde lid, gegeven verbod, wordt gestraft met gevangenisstraf van ten hoogste vier jaren of geldboete van de vijfde categorie.

3.

Hij die opzettelijk handelt in strijd met het in artikel 2 onder C, gegeven verbod wordt gestraft met gevangenisstraf van ten hoogste zes jaren of geldboete van de vijfde categorie.

4.

Hij die opzettelijk handelt in strijd met het in artikel 2 onder B of D, gegeven verbod, wordt gestraft met gevangenisstraf van ten hoogste acht jaren of geldboete van de vijfde categorie.

5.

Hij die opzettelijk handelt in strijd met een in artikel 2 onder A, gegeven verbod, wordt gestraft met gevangenisstraf van ten hoogste twaalf jaren of geldboete van de vijfde categorie.

6.

Indien het feit, bedoeld in het tweede, derde onderscheidenlijk vijfde lid, betrekking heeft op een geringe hoeveelheid, bestemd voor eigen gebruik, wordt gevangenisstraf van ten hoogste een jaar of geldboete van de derde categorie opgelegd.
