If an administrative authority, in the exercise of a task or power pursuant to this Act, has incurred additional costs as a result of a request for a decision or measure as referred to in Article 15.1, paragraph 1, an instruction or instruction rule concerning a location specified in that instruction or instruction rule, or a decision regarding the consent of another administrative authority, and no agreement has been reached regarding the allocation of those costs, it may request that administrative authority to reimburse the costs incurred by it, in whole or in part, insofar as those costs were incurred in connection with the promotion of an interest of that other administrative authority.
The compensation may be awarded insofar as:
the costs should reasonably not remain for the account of the legal entity to which the administrative authority belongs,
the compensation is not sufficiently secured in any other way, and
the compensation is not excluded by virtue of a statutory provision.
Als een bestuursorgaan bij de uitoefening van een taak of bevoegdheid op grond van deze wet extra kosten heeft gemaakt als gevolg van een verzoek om een besluit of maatregel als bedoeld in artikel 15.1, eerste lid, een instructie of instructieregel die gaat over een in die instructie of instructieregel aangegeven locatie of een besluit over instemming van een ander bestuursorgaan, en over de toedeling van die kosten geen overeenstemming is bereikt, kan het bij dat bestuursorgaan verzoeken om de door hem gemaakte kosten geheel of gedeeltelijk te vergoeden voor zover die kosten zijn gemaakt in verband met de behartiging van een belang van dat andere bestuursorgaan.
De vergoeding kan worden toegekend voor zover:
de kosten redelijkerwijs niet voor rekening behoren te blijven van de rechtspersoon waartoe het bestuursorgaan behoort,
de vergoeding niet voldoende op een andere manier is verzekerd, en
de vergoeding niet op grond van een wettelijk voorschrift is uitgesloten.
