If land consolidation forms part of the land development, the total surface area of all plots involved in the land consolidation shall, for each land consolidation block, be reduced by a maximum of five percent by the surface area of all plots included in the land consolidation block:
which is necessary in the interest of land consolidation for the establishment or improvement of public roads and water management works,
which is necessary for the construction of facilities that are connected to the public roads and public works for water management, as referred to under (a),
which is necessary for the implementation of measures and provisions for areas that are of importance from the perspective of nature conservation or landscape preservation, and for elements of landscape, recreational, geological or scientific value, or cultural heritage,
which is intended for other measures and provisions of public utility.
Als herverkaveling deel uitmaakt van de landinrichting, wordt bij elk herverkavelingsblok de totale oppervlakte van alle bij de herverkaveling betrokken percelen tot een maximum van vijf procent verminderd met de oppervlakte van alle in het herverkavelingsblok opgenomen percelen:
die in het belang van de herverkaveling nodig is voor het tot stand brengen of verbeteren van openbare wegen en waterstaatswerken,
die nodig is voor de aanleg van voorzieningen die met de openbare wegen en waterstaatswerken, bedoeld onder a, samenhangen,
die nodig is voor de verwezenlijking van maatregelen en voorzieningen voor gebieden die van belang zijn uit een oogpunt van natuurbescherming of landschapsbehoud, en voor elementen van landschappelijke, recreatieve, aardkundige of natuurwetenschappelijke waarde, of cultureel erfgoed,
die bestemd is voor andere maatregelen en voorzieningen van openbaar nut.
