A party entitled to an immovable property in respect of which the provincial executive or one of Our Ministers, for the purpose of executing the task referred to in Article 2.18, paragraph 1, under g, sub 2°, and Article 2.19, paragraph 5, under a, sub 1°, and under b, performs factual acts that are necessary in view of the conservation objectives for a Natura 2000 site or a special national nature area, shall tolerate the taking of these measures.

The competent authority shall inform a beneficiary as referred to in the first paragraph in writing of the intended measures at least four weeks in advance.

By way of derogation from the second paragraph, the information may be provided orally and the time limit shall not apply if this is necessary due to the urgent nature of the measure.

Een rechthebbende op een onroerende zaak waarvoor door het provinciebestuur of een van Onze Ministers ter uitvoering van de taak, bedoeld in artikel 2.18, eerste lid, onder g, onder 2°, en artikel 2.19, vijfde lid, onder a, onder 1°, en onder b, feitelijke handelingen worden verricht die nodig zijn gelet op de instandhoudingsdoelstellingen voor een Natura 2000-gebied of een bijzonder nationaal natuurgebied, gedoogt het treffen van deze maatregelen.

Het bevoegd gezag informeert een rechthebbende als bedoeld in het eerste lid ten minste vier weken van tevoren schriftelijk over de voorgenomen maatregelen.

3.

In afwijking van het tweede lid kan het informeren mondeling plaatsvinden en geldt de termijn niet, als dit nodig is vanwege het spoedeisende karakter van de maatregel.
