The Commissariaat consists of a chair and two or four other members.
An appointment shall be made for a period of five years, and reappointment for a consecutive period is possible once.
Without prejudice to Article 12 of the Framework Act on Autonomous Administrative Authorities (Kaderwet zelfstandige bestuursorganen), the appointment of the members of the Commissariaat by Our Minister shall take place upon the compelling nomination of the Commissariaat and with due observance of the fourth to the twelfth paragraphs inclusive.
In the event of a vacancy, the Commissariaat shall be responsible for the procedure leading to the nomination referred to in the third paragraph.
The Commissariaat shall draw up profile descriptions for the vacancy and for the Commissariaat as a whole.
The profile sketches require the approval of Our Minister.
The Commissariaat shall make the profile sketches public following approval.
For the selection of candidates, the Commissariaat shall establish an independent appointment advisory committee.
The appointment advisory committee is composed of an equal number of independent members, members on behalf of the Commissariaat, and members on behalf of Our Minister.
The advice of the appointment advisory committee is based on unanimous decision-making.
The appointment advisory committee shall issue a binding recommendation to the Commissariaat.
The nomination by the Commissariaat to Our Minister shall be reasoned, whereby in any event the suitability, the profile descriptions, the position of the candidate in the rotation schedule for retirement, and the procedure that led to the nomination shall be addressed.
Our Minister shall adopt the recommendation, unless it is in conflict with:
this Act;
due care requirements; or
other compelling interests.
Het Commissariaat bestaat uit een voorzitter en twee of vier andere leden.
Een benoeming geschiedt voor vijf jaar en herbenoeming voor een aansluitende periode is eenmaal mogelijk.
Onverminderd artikel 12 van de Kaderwet zelfstandige bestuursorganen gebeurt benoeming door Onze Minister van de leden van het Commissariaat op de zwaarwegende voordracht van het Commissariaat en met inachtneming van het vierde tot en met twaalfde lid.
Bij een vacature draagt het Commissariaat zorg voor de procedure die leidt tot de voordracht, bedoeld in het derde lid.
Het Commissariaat stelt profielschetsen op voor de vacature en voor het Commissariaat als geheel.
De profielschetsen behoeven de instemming van Onze Minister.
Het Commissariaat maakt de profielschetsen na de instemming openbaar.
Voor de selectie van kandidaten stelt het Commissariaat een onafhankelijke benoemingsadviescommissie in.
De benoemingsadviescommissie is samengesteld uit een gelijk aantal onafhankelijke leden, leden namens het Commissariaat en leden namens Onze Minister.
Het advies van de benoemingsadviescommissie berust op unanieme besluitvorming.
De benoemingsadviescommissie brengt aan het Commissariaat een bindend advies uit.
De voordracht van het Commissariaat aan Onze Minister is gemotiveerd, waarbij in elk geval wordt ingegaan op de geschiktheid, de profielschetsen, de positie van de kandidaat in het rooster van aftreden en de procedure die heeft geleid tot de voordracht.
Onze Minister neemt de voordracht over, tenzij deze in strijd is met:
deze wet;
eisen van zorgvuldigheid; of
andere zwaarwegende belangen.
