Our Minister shall reject an application for recognition or a provisional recognition if the applicant does not comply with Articles 2.24, 2.24a, 2.25, paragraph 1, points (a), (b) and (d), and paragraph 3, or 2.26, paragraph 1, points (a), (b), and (d) through (g).
Our Minister may reject an application if:
the applicant, as evidenced by the second evaluation referred to in Article 2.184, paragraph 3, has insufficiently contributed to the execution of the public media assignment at the national level due to the manner in which it has performed its public task referred to in Article 2.24, paragraph 1, point (b), or Article 2.24a, paragraph 1, point (b);
the applicant does not satisfy Article 2.30, paragraphs one up to and including three and paragraph five, or the requirements laid down pursuant to Article 2.30, paragraph four;
it is plausible that the applicant, also in view of his conduct during a preceding period in which he had an acknowledgment, will not comply with the provisions laid down by or pursuant to this Act; or
it appears from the application, in the opinion of Our Minister, that it is insufficiently demonstrated that:
the identity and mission of the applicant are expressed in the media offering to be provided by the applicant;
the media offering to be provided by the applicant complies with the requirements set for it by or pursuant to this Act; or
the applicant is prepared to cooperate for the benefit of the national public media service and its responsibility is guaranteed as referred to in Article 2.30, paragraph 2, point c.
In addition, Our Minister may reject an application if the application is not based on a proposal as referred to in Article 2.31, paragraph 3.
Onze Minister wijst een aanvraag voor een erkenning of een voorlopige erkenning af als de aanvrager niet voldoet aan de artikelen 2.24, 2.24a, 2.25, eerste lid, onderdelen a, b en d, en derde lid, of 2.26, eerste lid, onderdelen a, b, en d tot en met g.
Onze Minister kan een aanvraag afwijzen als:
de aanvrager blijkens de tweede evaluatie, bedoeld in artikel 2.184, derde lid, onvoldoende heeft bijgedragen aan de uitvoering van de publieke mediaopdracht op landelijk niveau door de wijze waarop hij uitvoering heeft gegeven aan zijn publieke taak, bedoeld in artikel 2.24, eerste lid, onderdeel b, of 2.24a, eerste lid, onderdeel b;
de aanvrager niet voldoet aan artikel 2.30, eerste tot en met derde en vijfde lid, of de krachtens artikel 2.30, vierde lid, gestelde eisen;
aannemelijk is dat de aanvrager zich, mede gelet op zijn handelwijze in een voorafgaande periode waarin hij een erkenning heeft gehad, niet zal houden aan het bepaalde bij of krachtens deze wet; of
uit de aanvraag naar de mening van Onze Minister onvoldoende blijkt dat:
in het door de aanvrager te verzorgen media-aanbod de identiteit en missie van de aanvrager tot uitdrukking komt;
het door de aanvrager te verzorgen media-aanbod voldoet aan de daaraan bij of krachtens deze wet gestelde eisen; of
de aanvrager bereid is tot samenwerking ten behoeve van de landelijk publieke mediadienst en zijn verantwoordelijkheid gewaarborgd is als bedoeld in artikel 2.30, tweede lid, onderdeel c.
Onze Minister kan daarnaast een aanvraag afwijzen als de aanvraag niet uitgaat van een voorstel als bedoeld in artikel 2.31, derde lid.
