The court determines the salary of the administrator in the judgment referred to in Article 354, paragraph 1.
The supervisory judge may, at the request of the administrator, during the application of the debt restructuring scheme, grant an advance on the salary each time for a period to be determined on that occasion.
If the application of the debt restructuring scheme (schuldsaneringsregeling) is terminated pursuant to Article 350 or Article 354a, the court shall thereby also determine the salary.
If the application of the debt restructuring scheme ends pursuant to the provisions of Article 312, paragraph 2, the court shall determine the salary as soon as the judgment declaring the bankruptcy has become final and unappealable.
In the event of an agreement, the salary is determined by the judgment of homologation.
The salary of the administrator is determined in accordance with rules to be laid down by Order in Council. If the court considers deviating from a proposal of the administrator for the determination of his salary, or if the supervisory judge does not agree with such a proposal, the court shall not take a decision as referred to in the first and third up to and including the fifth paragraph until after it has given the administrator the opportunity, in a manner to be further determined by it and within a time limit to be determined by it, to submit his views.
The salary of the administrator is a debt of the estate and is paid with priority over all other debts and over a payment referred to in Article 295, paragraph 5. The provisions of the preceding sentence also apply to the disbursements and to the publications prescribed pursuant to this title.
The costs of the publications prescribed pursuant to this title which cannot be paid from the estate, and the salary of experts, shall be borne by the State. The registrar of the court where the debtor has submitted his petition for the pronouncement of the application of the debt restructuring scheme, shall ensure the payment of the amount to be determined by the judge who determines the final salary of the administrator, which is to be borne by the State.
De rechtbank stelt het salaris van de bewindvoerder vast in het vonnis bedoeld in artikel 354, eerste lid.
De rechter-commissaris kan op verzoek van de bewindvoerder tijdens de toepassing van de schuldsaneringsregeling telkens voor een daarbij vast te stellen periode een voorschot op het salaris toekennen.
Indien de toepassing van de schuldsaneringsregeling wordt beëindigd op de voet van artikel 350 of artikel 354a, stelt de rechtbank daarbij tevens het salaris vast.
Eindigt de toepassing van de schuldsaneringsregeling op grond van het bepaalde in artikel 312, tweede lid, dan stelt de rechtbank het salaris vast zodra de uitspraak tot faillietverklaring in kracht van gewijsde is gegaan.
In geval van akkoord wordt het salaris bij het vonnis van homologatie bepaald.
Het salaris van de bewindvoerder wordt vastgesteld volgens bij algemene maatregel van bestuur te stellen regels. Overweegt de rechtbank om af te wijken van een voorstel van de bewindvoerder tot vaststelling van zijn salaris of stemt de rechter-commissaris niet met een dergelijk voorstel in, dan neemt de rechtbank geen beslissing als bedoeld in het eerste en derde tot en met vijfde lid dan nadat zij de bewindvoerder op een door haar nader te bepalen wijze en binnen een door haar te bepalen termijn in de gelegenheid heeft gesteld een zienswijze te geven.
Het salaris van de bewindvoerder is schuld van de boedel en wordt bij voorrang voldaan boven alle andere schulden en boven een betaling bedoeld in artikel 295, vijfde lid. Het in de vorige volzin bepaalde is ook van toepassing op de verschotten en op de publicaties die ingevolge deze titel zijn voorgeschreven.
De kosten van de ingevolge deze titel voorgeschreven publicaties die niet uit de boedel kunnen worden voldaan, en het salaris van deskundigen komen ten laste van de Staat. De griffier van de rechtbank waarbij de schuldenaar zijn verzoek tot het uitspreken van de toepassing van de schuldsaneringsregeling heeft ingediend, draagt zorg voor de voldoening van het door de rechter die het eindsalaris van de bewindvoerder bepaalt, vast te stellen bedrag dat ten laste van de Staat komt.
