If, at the beginning of the accounting period, the budget has not been adopted by the Administrative Council, expenditures may be effected on a monthly basis per heading or other division of the budget, in accordance with the Financial Regulations, up to one-twelfth of the budget appropriations for the preceding accounting period, provided that the appropriations thus made available to the President of the European Patent Office shall not exceed one-twelfth of those provided for in the draft budget.
The Administrative Council may, subject to the observance of the other provisions laid down in paragraph 1, authorise expenditure in excess of one-twelfth of the appropriations.
The payments referred to in Article 37(b), shall continue to be made, on a provisional basis, under the conditions determined under Article 39 for the year preceding that to which the draft budget relates.
The Contracting States shall pay each month, on a provisional basis and in accordance with the scale referred to in Article 40, paragraphs 3 and 4, any special financial contributions necessary to ensure implementation of paragraphs 1 and 2. Article 39, paragraph 4, shall apply mutatis mutandis to these contributions.
Indien aan het begin van een begrotingsjaar de begroting nog niet is vastgesteld door de Raad van Bestuur, kunnen de uitgaven maandelijks per hoofdstuk of andere onderverdeling worden verricht in overeenstemming met het Financieel Reglement tot ten hoogste een twaalfde deel van de op de begroting van het voorgaande jaar toegestane gelden, mits de aldus aan de President van het Europees Octrooibureau ter beschikking gestelde gelden niet meer bedragen dan een twaalfde deel van de op de ontwerpbegroting voorziene gelden.
De Raad van Bestuur kan, evenwel met inachtneming van de overige in het eerste lid vastgestelde voorwaarden, machtiging verlenen voor uitgaven die een twaalfde deel te boven gaan.
De betalingen bedoeld in artikel 37, onderdeel b, zullen voorshands worden verricht overeenkomstig artikel 39 op basis van het begrotingsjaar voorafgaande aan dat waarop de ontwerpbegroting betrekking heeft.
Elke maand betalen de Verdragsluitende Staten, als voorschot en overeenkomstig de in artikel 40, derde en vierde lid, bedoelde verdeelsleutel, de bijzondere financiële bijdragen voor zover dit nodig is om aan het eerste en tweede lid van dit artikel uitvoering te geven. Artikel 39, vierde lid, is op deze bijdragen van overeenkomstige toepassing.
