1.

The contractual liability of the Organisation shall be governed by the law applicable to the contract in question.

2.

The non-contractual liability of the Organisation in respect of any damage caused by it or by the employees of the European Patent Office in the performance of their duties shall be governed by the law of the Federal Republic of Germany. Where the damage is caused by the branch at The Hague or a sub-office or employees attached thereto, the law of the Contracting State in which such branch or sub-office is located shall apply.

3.

The personal liability of the employees of the European Patent Office towards the Organisation shall be governed by their Service Regulations or conditions of employment.

4.

The courts with jurisdiction to settle disputes under paragraphs 1 and 2 shall be:

a.

for disputes under paragraph 1, the courts of the Federal Republic of Germany, unless the contract concluded between the parties designates a court of another State;

b.

for disputes under paragraph 2, the courts of the Federal Republic of Germany, or of the State in which the branch or sub-office is located.

De contractuele aansprakelijkheid van de Organisatie wordt beheerst door het recht dat van toepassing is op de desbetreffende overeenkomst.

2.

De niet-contractuele aansprakelijkheid van de Organisatie voor schade die wordt veroorzaakt door de Organisatie of door het personeel van het Europees Octrooibureau in de uitoefening van hun taken, wordt beheerst door het recht van de Bondsrepubliek Duitsland. Indien de schade is veroorzaakt door het onderdeel te Den Haag of door een bijkantoor, of door het personeel van het onderdeel of van dat bijkantoor, is het recht van de Verdragsluitende Staat waarin het onderdeel of het bijkantoor is gevestigd van toepassing.

De persoonlijke aansprakelijkheid van het personeel van het Europees Octrooibureau jegens de Organisatie wordt beheerst door de voorschriften van hun ambtenarenreglement of door de op hen van toepassing zijnde arbeidsvoorwaarden.

4.

De gerechtelijke instanties die bevoegd zijn tot het beslechten van de in het eerste en tweede lid bedoelde geschillen zijn:

a.

voor geschillen bedoeld in het eerste lid, de gerechtelijke instanties van de Bondsrepubliek Duitsland, tenzij in de tussen de partijen gesloten overeenkomst een gerechtelijke instantie van een andere Staat is aangewezen;

b.

voor geschillen bedoeld in het tweede lid, de gerechtelijke instanties van de Bondsrepubliek Duitsland, of van de Staat waarin het onderdeel of het bijkantoor is gevestigd.
