An invention shall be considered to be new if it does not form part of the state of the art.
The state of the art shall be held to comprise everything made available to the public by means of a written or oral description, by use, or in any other way, before the date of filing of the European patent application.
Additionally, the content of European patent applications as filed, the dates of filing of which are prior to the date referred to in paragraph 2 and which were published on or after that date, shall be considered as comprised in the state of the art.
Paragraphs 2 and 3 shall not exclude the patentability of any substance or composition, comprised in the state of the art, for use in a method referred to in Article 53(c), provided that its use for any such method is not comprised in the state of the art.
Paragraphs 2 and 3 shall also not exclude the patentability of any substance or composition referred to in paragraph 4 for any specific use in a method referred to in Article 53(c), provided that such use is not comprised in the state of the art.
Een uitvinding wordt als nieuw beschouwd indien zij geen deel uitmaakt van de stand van de techniek.
De stand van de techniek wordt gevormd door al hetgeen vóór de datum van indiening van de Europese octrooiaanvrage openbaar toegankelijk is gemaakt door een schriftelijke of mondelinge beschrijving, door toepassing of op enige andere wijze.
Als behorend tot de stand van de techniek wordt tevens aangemerkt de inhoud van Europese octrooiaanvragen, zoals die zijn ingediend, waarvan de datum van indiening gelegen is vóór de in het tweede lid genoemde datum en die op of na die datum zijn gepubliceerd.
Het tweede en derde lid sluiten de octrooieerbaarheid van stoffen of mengsels, behorend tot de stand van de techniek, voor toepassing bij een in artikel 53, onderdeel c, bedoelde methode niet uit, mits de toepassing ervan bij een dergelijke methode niet behoort tot de stand van de techniek.
Het tweede en derde lid sluiten voorts niet de octrooieerbaarheid uit van stoffen of mengsels als bedoeld in het vierde lid voor een specifieke toepassing in een werkwijze bedoeld in artikel 53, onderdeel c, mits die toepassing niet tot de stand van de techniek behoort.
