The provision of e-commerce services is presumed to comply with the requirements referred to in Annex I, Sections III and IV, point (g), of Directive (EU) 2019/882, if the harmonised standards or parts thereof, established in relation to that Directive and covering the relevant requirements, have been met.
A presumption of conformity as referred to in paragraph 1 exists if the provision of e-commerce services complies with:
the harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union and which standards are in force;
the technical specifications or parts thereof, insofar as these technical specifications or parts thereof cover those regulations.
The provision of e-commerce services in accordance with the requirements referred to in Annex I, Section VI, of Directive (EU) 2019/882, is presumed to comply with the accessibility obligations under Union acts other than that Directive, unless otherwise provided in those other Union acts.
The provision of e-commerce services that comply with the harmonised standards or technical specifications or parts of those standards or specifications, as referred to in paragraph 2, point (a) or (b), shall be presumed to be in conformity with paragraph 3, insofar as these standards or technical specifications or parts thereof satisfy the accessibility requirements of Directive (EU) 2019/882.
Het verlenen van e-handelsdiensten wordt vermoed te voldoen aan de eisen, bedoeld in bijlage I, afdelingen III en IV, onderdeel g, van richtlijn (EU) 2019/882, indien is voldaan aan de met betrekking tot die richtlijn vastgestelde geharmoniseerde normen of delen daarvan, die betrekking hebben op de desbetreffende eisen.
Van een vermoeden van overeenstemming als bedoeld in lid 1 is sprake indien het verlenen van e-handelsdiensten voldoet aan:
de geharmoniseerde normen of delen daarvan waarvan de referenties bekend zijn gemaakt in het Publicatieblad van de Europese Unie en deze normen van kracht zijn;
de technische specificaties of delen daarvan, voor zover deze technische specificaties of delen daarvan die voorschriften bestrijken.
Het verlenen van e-handelsdiensten in overeenstemming met de eisen, bedoeld in bijlage I, afdeling VI, van richtlijn (EU) 2019/882, wordt vermoed te voldoen aan de verplichtingen inzake toegankelijkheid krachtens andere Uniehandelingen dan die richtlijn, tenzij in die andere Uniehandelingen anders wordt bepaald.
Het verlenen van e-handelsdiensten die voldoen aan de geharmoniseerde normen of technische specificaties of delen van die normen of specificaties, bedoeld in lid 2, onderdeel a of b, wordt vermoed in overeenstemming te zijn met lid 3, voor zover deze normen of technische specificaties of delen daarvan voldoen aan de toegankelijkheidsvoorschriften van richtlijn (EU) 2019/882.
