The custodian may only deliver the object to the creditor if the latter pays him all costs of the custody. After delivery, he is obliged to reimburse the depositor for what the latter had already paid. If the object was delivered before the creditor paid all costs, the rights in this matter shall pass to the custodian upon payment to the depositor.
De bewaarder mag de zaak slechts aan de schuldeiser afgeven, indien deze hem alle kosten van de bewaring voldoet. Hij is na de afgifte verplicht aan de bewaargever terug te betalen, wat deze reeds had voldaan. Is de zaak afgegeven, vóórdat de schuldeiser alle kosten voldeed, dan gaan de rechten te dier zake door de betaling aan de bewaargever op de bewaarder over.
