The spouse who is under guardianship (onder curatele) may, after the solemnisation of the marriage (voltrekking van het huwelijk), only make or amend prenuptial or postnuptial agreements with the consent of his guardian (curator).

De echtgenoot die onder curatele staat, kan na de huwelijksvoltrekking slechts met toestemming van zijn curator huwelijkse voorwaarden maken of wijzigen.

Court of Appeal confirms the authorisation granted by the subdistrict court judge to the curator to amend the prenuptial agreements of the person placed under curatorship and his spouse (Art. 1:386 paragraph 1 BW and Art. 1:345 paragraph 1 BW). Question of whether the person placed under curatorship is admissible in an appeal in cassation against this. Consent of the curator? Question of whether Art. 1:118 BW prevents the curator from acting as the legal representative of the person placed under curatorship when entering into or amending prenuptial agreements during the marriage.
