The child has the right to contact with his parents and with those who stand in a close personal relationship to him. The parent not vested with authority has the right to and the obligation of contact with his child.
The court shall, upon the petition of the parents or one of them or a person who stands in a close personal relationship to the child, establish an arrangement regarding the exercise of the right of contact, whether or not for a specified period, or deny, whether or not for a specified period, the right of contact.
The court shall only deny the right of contact if:
contact would result in serious harm to the mental or physical development of the child, or
the parent or the person who stands in a close personal relationship to the child must be deemed manifestly unfit or manifestly unable to have contact, or
the child who is twelve years of age or older, during his hearing, has manifested serious objections to contact with his parent or with the person with whom he has a close personal relationship, or
contact is otherwise contrary to the compelling interests of the child.
Het kind heeft het recht op omgang met zijn ouders en met degene die in een nauwe persoonlijke betrekking tot hem staat. De niet met het gezag belaste ouder heeft het recht op en de verplichting tot omgang met zijn kind.
De rechter stelt op verzoek van de ouders of van een van hen of degene die in een nauwe persoonlijke betrekking staat tot het kind, al dan niet voor bepaalde tijd, een regeling inzake de uitoefening van het omgangsrecht vast dan wel ontzegt, al dan niet voor bepaalde tijd, het recht op omgang.
De rechter ontzegt het recht op omgang slechts, indien:
omgang ernstig nadeel zou opleveren voor de geestelijke of lichamelijke ontwikkeling van het kind, of
de ouder of degene die in een nauwe persoonlijke betrekking staat tot het kind kennelijk ongeschikt of kennelijk niet in staat moet worden geacht tot omgang, of
het kind dat twaalf jaren of ouder is, bij zijn verhoor van ernstige bezwaren tegen omgang met zijn ouder of met degene met wie hij in een nauwe persoonlijke betrekking staat heeft doen blijken, of
omgang anderszins in strijd is met zwaarwegende belangen van het kind.
