The certified institution may, in the performance of its duties, issue written instructions (aanwijzingen) regarding the care and upbringing of the minor. It may do so if the parent vested with authority or the minor does not consent to, or fails to cooperate or provides insufficient cooperation with, the implementation of the plan referred to in Article 4.1.3, paragraph 1, of the Youth Act (Jeugdwet), or if this is necessary in order to remove specific threats to the development of the minor.
The parents or parent burdened with authority and the minor shall comply with a written instruction.
The certified institution may petition the children's court judge to confirm a written instruction. Simultaneously, a measure of enforcement permitted by law may be petitioned for in the event of non-compliance with this instruction, unless the best interests of the child oppose the imposition thereof.
De gecertificeerde instelling kan ter uitvoering van haar taak schriftelijke aanwijzingen geven betreffende de verzorging en opvoeding van de minderjarige. Zij kan dit doen indien de met het gezag belaste ouder of de minderjarige niet instemmen met, dan wel niet of onvoldoende medewerking verlenen aan de uitvoering van het plan, bedoeld in artikel 4.1.3, eerste lid, van de Jeugdwet of indien dit noodzakelijk is teneinde de concrete bedreigingen in de ontwikkeling van de minderjarige weg te nemen.
De met het gezag belaste ouders of ouder en de minderjarige volgen een schriftelijke aanwijzing op.
De gecertificeerde instelling kan de kinderrechter verzoeken een schriftelijke aanwijzing te bekrachtigen. Tegelijkertijd kan een door de wet toegelaten dwangmiddel worden verzocht bij niet nakoming van deze aanwijzing tenzij het belang van het kind zich tegen oplegging daarvan verzet.

Authority is exercised over each minor child individually, and the statutory criteria for the application of this measure must be met for each child separately. In the case of each individual minor child, therefore, only the rights and obligations arising from the authority over this child, pertaining to this child and the parents exercising authority over this child or the foster parents, are involved. This is not altered by the fact that a decision for out-of-home placement also affects the right of the other minor children to the protection of their family life with the child concerned, as guaranteed by Article 8 ECHR.
