1.

The parent who is competent to exercise authority over the child, and who has never exercised authority jointly with the mother from whom the child was born, may petition the court to charge the parents with joint authority or to charge him alone with authority over the child.

2.

If the petition (application) seeks to charge the parents with joint authority and the other parent with joint authority does not consent, the petition shall be denied only if:

a.

there is an unacceptable risk that the child would become trapped or lost between the parents and it is not to be expected that sufficient improvement would occur in this regard within the foreseeable future, or

b.

rejection is otherwise necessary in the interests of the child.

3.

When the other parent exercises parental authority over the child, the petition to charge the parent who is eligible for parental authority, as referred to in the first paragraph, with sole parental authority shall only be granted if the court deems this desirable in the interest of the child.

4.

Where provision for authority has not been made or where a guardian exercises authority, the petition to charge the parent entitled to authority, as referred to in the first paragraph, solely with authority shall only be denied if there is a well-founded fear that the interests of the child would be neglected upon granting the petition.

5.

A petition to charge the parents with joint parental authority as referred to in the first paragraph may also be filed by the mother from whom the child was born.

De tot het gezag bevoegde ouder van het kind, die nimmer het gezag gezamenlijk met de moeder uit wie het kind is geboren heeft uitgeoefend, kan de rechtbank verzoeken de ouders met het gezamenlijk gezag dan wel hem alleen met het gezag over het kind te belasten.

2.

Indien het verzoek ertoe strekt de ouders met het gezamenlijk gezag te belasten en de andere ouder met gezamenlijk gezag niet instemt, wordt het verzoek slechts afgewezen indien:

a.

er een onaanvaardbaar risico is dat het kind klem of verloren zou raken tussen de ouders en niet te verwachten is dat hierin binnen afzienbare tijd voldoende verbetering zou komen, of

b.

afwijzing anderszins in het belang van het kind noodzakelijk is.

3.

Wanneer de andere ouder het gezag over het kind uitoefent, wordt het verzoek om de tot het gezag bevoegde ouder, bedoeld in het eerste lid, alleen met het gezag te belasten slechts ingewilligd, indien de rechtbank dit in het belang van het kind wenselijk oordeelt.

4.

Wanneer niet in het gezag is voorzien of wanneer een voogd het gezag uitoefent, wordt het verzoek om de tot het gezag bevoegde ouder, bedoeld in het eerste lid, alleen met het gezag te belasten slechts afgewezen, indien gegronde vrees bestaat dat bij inwilliging de belangen van het kind zouden worden verwaarloosd.

5.

Een verzoek om de ouders met het gezamenlijk gezag te belasten als bedoeld in het eerste lid, kan ook door de moeder uit wie het kind is geboren worden gedaan.
