Dissolution of the marriage of spouses who are legally separated (scheiding van tafel en bed) is pronounced upon the petition of one of the spouses, if the separation has lasted at least three years.
The term of three years may, upon the petition of a spouse, be shortened to at least one year, if the other spouse is continuously guilty of misconduct to such an extent that it cannot be required of the spouse who has made the petition to continue the marriage.
Ontbinding van het huwelijk van echtgenoten die van tafel en bed gescheiden zijn, wordt op verzoek van een der echtgenoten uitgesproken, indien de scheiding ten minste drie jaren heeft geduurd.
De termijn van drie jaren kan op verzoek van een echtgenoot worden bekort tot ten minste een jaar, indien de andere echtgenoot zich gedurig schuldig maakt aan wangedrag in zodanige mate dat van de echtgenoot, die het verzoek heeft gedaan, niet kan worden gevergd het huwelijk te doen voortbestaan.
