The applicant for a certification mark must submit the regulations governing the use thereof upon filing the application.
However, if it concerns an international application, the applicant may still deposit these regulations during a period of six months calculated from the notification of the international registration referred to in Article 3(4) of the Madrid Agreement and Protocol.
The regulations governing use shall specify the persons authorised to use the mark, the characteristics to be certified by the mark, how the certifying body is to test those characteristics and how it is to supervise the use of the mark. Those regulations shall also determine the conditions under which the mark may be used, as well as the sanctions that may be imposed.
De aanvrager van een certificeringsmerk moet bij de aanvraag het reglement inzake het gebruik daarvan indienen.
Indien het evenwel gaat om een internationale aanvraag kan de aanvrager dit reglement nog deponeren gedurende een termijn van zes maanden te rekenen vanaf de in artikel 3, sub (4), van de Overeenkomst en het Protocol van Madrid bedoelde kennisgeving van de internationale inschrijving.
Het gebruiksreglement geeft aan welke personen het merk mogen gebruiken, welke kenmerken door het merk worden gecertificeerd, hoe de certificeringsinstantie deze kenmerken moet testen en hoe zij moet toezien op het gebruik van het merk. Dat reglement bepaalt tevens onder welke voorwaarden het merk kan worden gebruikt, alsmede welke sancties kunnen worden opgelegd.
