The right to the trademark shall lapse:
by the voluntary cancellation or the expiry of the validity period of the registration of the trademark;
due to the cancellation or the expiry of the term of validity of the international registration or due to a renunciation of the protection in the Benelux territory, or, in accordance with the provisions of Article 6 of the Madrid Agreement and Protocol, due to the fact that the trademark no longer enjoys legal protection in the country of origin.
Het recht op het merk vervalt:
door de vrijwillige doorhaling of het verstrijken van de geldigheidsduur van de inschrijving van het merk;
door de doorhaling of het verstrijken van de geldigheidsduur van de internationale inschrijving of door afstand van de bescherming in het Benelux-gebied, of overeenkomstig het in artikel 6 van de Overeenkomst en het Protocol van Madrid bepaalde, door het feit dat het merk geen wettelijke bescherming meer geniet in het land van oorsprong.
