The proprietor of a trademark may prohibit the use of a sign only insofar as the rights of the proprietor cannot be declared lapsed pursuant to Article 2.27, paragraphs 2 through 5, at the time the action for infringement is instituted. If the defendant so requests, the proprietor of the trademark shall provide proof that, during the period of five years preceding the date on which the action is instituted, genuine use of the trademark has been made as referred to in Article 2.23bis for the goods or services for which it is registered and which are cited in justification of the action, or that there were proper reasons for non-use, provided that the registration procedure for the trademark was completed at least five years prior to the date on which the action is instituted.
De houder van een merk kan het gebruik van een teken alleen verbieden voor zover de rechten van de houder niet op grond van artikel 2.27, lid 2 tot en met 5, vervallen kunnen worden verklaard op het tijdstip waarop de vordering wegens inbreuk wordt ingesteld. Indien de verweerder daarom verzoekt, levert de houder van het merk het bewijs dat gedurende de periode van vijf jaar voorafgaand aan de datum waarop de vordering wordt ingesteld, normaal gebruik van het merk is gemaakt als bedoeld in artikel 2.23bis, voor de waren of diensten waarvoor het is ingeschreven, en die ter rechtvaardiging van de vordering worden aangehaald, dan wel dat er geldige redenen voor het niet-gebruik bestonden, op voorwaarde dat de procedure van inschrijving van het merk op de datum waarop de vordering wordt ingesteld, reeds ten minste vijf jaar geleden is afgerond.
