If the Office determines that Article 3.6, sub e, is applicable to the design or model, it shall suspend the publication.
The Office shall notify the depositor thereof and request him to withdraw his deposit within a period of two months.
If the interested party has not withdrawn his deposit after the expiry of this period, the Office shall refuse the publication. The Office shall notify the depositor of the refusal to publish in writing without delay, stating the reasons, and shall mention the legal remedy against that decision referred to in Article 1.15bis.
The refusal to publish shall only become final once the decision of the Office is no longer subject to any legal remedy. This shall result in the nullity of the filing.
Indien het Bureau oordeelt, dat op de tekening of het model artikel 3.6, sub e, van toepassing is schort hij de publicatie op.
Het Bureau stelt de deposant daarvan in kennis en verzoekt hem zijn depot binnen een termijn van twee maanden in te trekken.
Indien de belanghebbende na het verstrijken van deze termijn zijn depot niet heeft ingetrokken, weigert het Bureau de publicatie. Van de weigering tot publicatie geeft het Bureau onder opgave van redenen onverwijld schriftelijk kennis aan de deposant, onder vermelding van het in artikel 1.15bis genoemde rechtsmiddel tegen die beslissing.
De weigering tot publicatie wordt eerst definitief nadat de beslissing van het Bureau niet meer vatbaar is voor enig rechtsmiddel. Dit heeft de nietigheid van het depot tot gevolg.
