Article 3.5

Without prejudice to the right of priority, the exclusive right to a design or model is obtained by the registration of the filing, effected within the Benelux territory at the Office (Benelux filing), or effected at the International Bureau (international filing).
If, in the event of concurrent filings, the first filing is not followed by the publication as referred to in Article 3.11, paragraph 2, of this Treaty or in Article 6, under 3, of the Hague Agreement, the subsequent filing shall acquire the priority of the first filing.
Onverminderd het recht van voorrang wordt het uitsluitend recht op een tekening of model verkregen door de inschrijving van het depot, verricht binnen het Benelux-gebied bij het Bureau (Benelux-depot), of verricht bij het Internationaal Bureau (internationaal depot).
Indien bij samenloop van depots het eerste depot niet wordt gevolgd door de publicatie als bedoeld in artikel 3.11, lid 2, van dit verdrag of in artikel 6, onder 3 van de Overeenkomst van 's-Gravenhage, verkrijgt het latere depot de rang van eerste depot.
