Without prejudice to the right of priority arising from the Paris Convention or the TRIPS Agreement, the exclusive right to a trademark pursuant to this treaty is acquired by the registration of the trademark, the application for which has been filed within the Benelux territory (Benelux trademark), or arising from a registration with the International Bureau the protection of which extends to the Benelux territory (international trademark).
Onverminderd het uit het Verdrag van Parijs of het TRIPS verdrag voortvloeiende recht van voorrang, wordt het uitsluitend recht op een merk ingevolge dit verdrag verkregen door de inschrijving van het merk, waarvan de aanvraag is verricht binnen het Benelux-gebied (Beneluxmerk) of voortvloeiend uit een inschrijving bij het Internationaal Bureau waarvan de bescherming zich uitstrekt tot het Beneluxgebied (internationaal merk).
