In his decision to revoke Netherlands nationality on the basis of Article 14, paragraph 4, of the Kingdom Act, Our Minister shall, inter alia, take into account:
the proportionality of the measure, also in view of the role fulfilled by the person concerned within the organisation referred to in Article 14, fourth paragraph, of the Kingdom Act and the related degree of threat to national security posed by the person concerned;
the possible interest of detection, prosecution and trial of the person concerned and the possibility of execution of a custodial sentence;
the consequences of the loss of Union citizenship, if this occurs as a result of the withdrawal of Netherlands nationality; and
the possible minority of the person concerned and very special personal circumstances of the person concerned, insofar as these are relevant to the decision to revoke the Netherlands citizenship.
Withdrawal of Netherlands citizenship shall not take place if the declaration of undesirability associated with the withdrawal would be in conflict with Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
Bij zijn besluit tot intrekking van het Nederlanderschap op grond van artikel 14, vierde lid, van de Rijkswet houdt Onze Minister onder meer rekening met:
de proportionaliteit van de maatregel, mede gelet op de rol die betrokkene vervult bij de in artikel 14, vierde lid, van de Rijkswet bedoelde organisatie en de daarmee samenhangende mate van dreiging voor de nationale veiligheid die van betrokkene uitgaat;
het eventuele belang van opsporing, vervolging en berechting van betrokkene en de mogelijkheid van tenuitvoerlegging van een vrijheidsstraf;
de gevolgen van het verlies van Unieburgerschap, indien dit ten gevolge van de intrekking van het Nederlanderschap optreedt; en
de eventuele minderjarigheid van betrokkene en zeer bijzondere persoonlijke omstandigheden van betrokkene, voor zover deze relevant zijn voor het besluit tot intrekking van het Nederlanderschap.
Intrekking van het Nederlanderschap vindt niet plaats indien de met de intrekking verband houdende ongewenstverklaring in strijd zou zijn met artikel 8 van het Verdrag tot bescherming van de rechten van de mens en de fundamentele vrijheden.
