in forceThe protection of this Convention shall apply to:
authors who are nationals of one of the countries of the Union, for their works, whether published or not;
authors who are not nationals of one of the countries of the Union, for their works first published in one of those countries, or simultaneously in a country outside the Union and in a country of the Union.
Authors who are not nationals of one of the countries of the Union but who have their habitual residence in one of them shall, for the purposes of this Convention, be assimilated to nationals of that country.
The expression “published works” means works published with the consent of their authors, whatever may be the means of manufacture of the copies, provided that the availability of such copies has been such as to satisfy the reasonable requirements of the public, having regard to the nature of the work. The performance of a dramatic, dramaticomusical, cinematographic or musical work, the public recitation of a literary work, the communication by wire or the broadcasting of literary or artistic works, the exhibition of a work of art and the construction of a work of architecture shall not constitute publication.
A work shall be considered as having been published simultaneously in several countries if it has been published in two or more countries within thirty days of its first publication.
Krachtens deze Conventie genieten bescherming:
auteurs die onderdaan zijn van een van de landen van de Unie, voor hun al dan niet gepubliceerde werken;
auteurs die geen onderdaan zijn van een van de landen van de Unie, voor de werken die zij voor het eerst publiceren in een van deze landen of gelijktijdig in een land dat geen lid van de Unie is en in een land van de Unie.
Auteurs die geen onderdaan zijn van een van de landen van de Unie doch die hun gewone verblijfplaats in een van deze landen hebben, worden voor de toepassing van deze Conventie gelijkgesteld met onderdanen van dat land.
Onder „gepubliceerde werken” moeten worden verstaan de werken die met toestemming van hun auteur zijn uitgegeven, welke ook de wijze van vervaardiging moge zijn van de exemplaren, mits deze zodanig ter beschikking zijn gesteld dat daarmede wordt voorzien in de redelijke behoeften van het publiek, zulks met inachtneming van de aard van het werk. De opvoering van een toneelwerk of dramatisch-muzikaal werk, de vertoning van een cinematografisch werk, de uitvoering van een muziekwerk, de openbare voordracht van een werk van letterkunde, de overbrenging of radio-uitzending van werken van letterkunde of kunst, de tentoonstelling van een kunstwerk en het bouwen van een bouwwerk vormen geen publikatie.
Als gelijktijdig in verscheidene landen gepubliceerd wordt beschouwd elk werk, dat binnen dertig dagen na zijn eerste publikatie in twee of meer landen verschenen is.
