The head of the institution is authorised to search the body or clothing of a patient upon entry into or departure from an institution, prior to or after a visit, or if this is otherwise necessary in the interest of protecting society against the danger posed by the patient to the safety of others than the patient or the general safety of persons or property, or for the maintenance of order or safety within the institution.
Our Minister is authorised, for the purpose of transporting the person being nursed, to search his person or his clothing.
The examination of the body of the person being cared for shall also include the external inspection of the orifices and cavities of the body of the person being cared for. The examination of the clothing of the person being cared for shall also include the examination of the objects that the person being cared for has on their person or is carrying with them.
The examination of the body of the patient shall be performed in private areas and, as far as possible, by persons of the same sex as the patient.
If, during an examination of the body or clothing, objects are found that the patient is not permitted to possess, the head of the institution is authorised to seize them. This authority also includes the removal of such objects from the orifices and cavities of the body, insofar as this can be performed without the use of aids. He shall ensure that these objects are either kept in storage for the benefit of the patient against issuance of a receipt, destroyed in the patient's presence with the patient's consent, or handed over to an investigative officer with a view to the prevention or detection of criminal offences.
Het hoofd van de instelling is bevoegd een verpleegde bij binnenkomst in of bij het verlaten van een instelling, voorafgaand aan of na afloop van bezoek, dan wel indien dit anderszins noodzakelijk is in het belang van de bescherming van de maatschappij tegen de gevaarlijkheid van de verpleegde voor de veiligheid van anderen dan de verpleegde of de algemene veiligheid van personen of goederen dan wel de handhaving van de orde of de veiligheid in de instelling, aan zijn lichaam of aan zijn kleding te onderzoeken.
Onze Minister is bevoegd ten behoeve van het vervoer van de verpleegde hem aan zijn lichaam of aan zijn kleding te onderzoeken.
Het onderzoek aan het lichaam van de verpleegde omvat mede het uitwendig schouwen van de openingen en holten van het lichaam van de verpleegde. Het onderzoek aan de kleding van de verpleegde omvat mede het onderzoek van de voorwerpen die de verpleegde bij zich draagt of met zich mee voert.
Het onderzoek aan het lichaam van de verpleegde wordt op besloten plaatsen en, voor zover mogelijk, door personen van hetzelfde geslacht als de verpleegde verricht.
Indien bij een onderzoek aan het lichaam of de kleding voorwerpen worden aangetroffen die niet in het bezit van de verpleegde mogen zijn is het hoofd van de instelling bevoegd deze in beslag te nemen. Deze bevoegdheid omvat mede het verwijderen van deze voorwerpen uit de openingen en holten van het lichaam voor zover dit kan plaatsvinden zonder het gebruik van hulpmiddelen. Hij draagt zorg dat deze voorwerpen, hetzij onder afgifte van een bewijs van ontvangst ten behoeve van de verpleegde worden bewaard, hetzij met toestemming van de verpleegde in diens aanwezigheid worden vernietigd, hetzij aan een opsporingsambtenaar ter hand worden gesteld met het oog op de voorkoming of opsporing van strafbare feiten.
