This Act applies to the broadcasting of a work included in a radio or television programme by means of a satellite, if the act referred to in Article 12, paragraph 7, takes place in the Netherlands.
This Act shall furthermore apply to the broadcasting of a work included in a radio or television programme by means of a satellite, if:
the act, referred to in Article 12, paragraph 7, takes place in a country that does not belong to the European Union or that is not a party to the Agreement on the European Economic Area of 2 May 1992;
the country where the act, referred to in Article 12, paragraph 7, takes place does not provide the level of protection provided for in Chapter II of Council Directive 93/83/EEC of 27 September 1993 on the coordination of certain rules concerning copyright and rights related to copyright applicable to satellite broadcasting and cable retransmission (OJ EC L 248); and
either the programme-carrying signals are transmitted to the satellite from an earth station located in the Netherlands, or a broadcasting organisation which has its principal place of business in the Netherlands has commissioned the broadcast and no use is made of an earth station located in a Member State of the European Union or in a state that is a party to the Agreement on the European Economic Area of 2 May 1992.
Deze wet is van toepassing op het uitzenden van een in een radio- of televisieprogramma opgenomen werk door middel van een satelliet, indien de handeling, bedoeld in artikel 12, zevende lid, in Nederland plaatsvindt.
Deze wet is voorts van toepassing op het uitzenden van een in een radio- of televisieprogramma opgenomen werk door middel van een satelliet, indien:
de handeling, bedoeld in artikel 12, zevende lid, plaatsvindt in een land dat niet tot de Europese Unie behoort of dat niet partij is bij de Overeenkomst betreffende de Europese Economische Ruimte van 2 mei 1992;
het land waar de handeling, bedoeld in artikel 12, zevende lid, plaatsvindt niet het niveau van bescherming biedt, voorzien in hoofdstuk II van richtlijn nr. 93/83/EEG van de Raad van de Europese Gemeenschappen van 27 september 1993 tot coördinatie van bepaalde voorschriften betreffende het auteursrecht en naburige rechten op het gebied van de satellietomroep en de doorgifte via de kabel (PbEG L 248); en
hetzij de programmadragende signalen naar de satelliet worden doorgezonden vanuit een grondstation in Nederland, hetzij een omroeporganisatie, die in Nederland haar hoofdvestiging heeft, opdracht heeft gegeven tot de uitzending en geen gebruik wordt gemaakt van een grondstation in een lid-staat van de Europese Unie of in een staat die partij is bij de Overeenkomst betreffende de Europese Economische Ruimte van 2 mei 1992.
