The resale right expires at the time the copyright expires.
By way of derogation from the first paragraph, in the case of a sale of an original of a work of art prior to 1 January 2010, the remuneration referred to in Article 43a, first paragraph, is not due to the successors in title of the author by way of succession.
The period referred to in the second paragraph may be extended by Order in Council until no later than 1 January 2012.
Het volgrecht vervalt op het tijdstip waarop het auteursrecht vervalt.
In afwijking van het eerste lid is bij een verkoop van een origineel van een kunstwerk tot 1 januari 2010 de vergoeding, bedoeld in artikel 43a, eerste lid, niet verschuldigd aan de rechtverkrijgenden van de maker krachtens erfopvolging.
Bij algemene maatregel van bestuur kan de in het tweede lid bedoelde periode worden verlengd tot uiterlijk 1 januari 2012.
