Notwithstanding the total or partial assignment of his copyright, the author remains entitled to institute legal proceedings to claim damages against the person who has infringed the copyright.
In appropriate cases, the court may determine the damages as a lump sum.
The legal claim referred to in the first paragraph for obtaining damages due to copyright infringement shall, after the death of the author, accrue to his heirs or legatees until the expiry of the copyright.
Niettegenstaande de gehele of gedeeltelijke overdracht van zijn auteursrecht blijft de maker bevoegd een rechtsvordering ter verkrijging van schadevergoeding in te stellen tegen degene, die inbreuk op het auteursrecht heeft gemaakt.
In passende gevallen kan de rechter de schadevergoeding vaststellen als een forfaitair bedrag.
De in het eerste lid bedoelde rechtsvordering ter verkrijging van schadevergoeding wegens inbreuk op het auteursrecht komt na het overlijden van de maker toe aan zijn erfgenamen of legatarissen tot aan het vervallen van het auteursrecht.
