The seller of the objects referred to in Article 16c, paragraph 1, is obliged, upon the request of the legal entity referred to in Article 16d, paragraph 1, to provide for inspection without delay those documents the examination of which is necessary to determine whether the remuneration referred to in Article 16c, paragraph 2, has been paid by the manufacturer or the importer.
If the seller cannot demonstrate that the remuneration has been paid by the manufacturer or the importer, he is obliged to pay it to the legal entity referred to in Article 16d, paragraph 1, unless it appears from the documents mentioned in the first paragraph who the manufacturer or the importer is.
De verkoper van de in artikel 16c, eerste lid bedoelde voorwerpen is gehouden aan de in artikel 16d, eerste lid, bedoelde rechtspersoon op diens aanvraag onverwijld die bescheiden ter inzage te geven waarvan de kennisneming noodzakelijk is om vast te stellen of de in artikel 16c, tweede lid, bedoelde vergoeding door de fabrikant of de importeur betaald is.
Indien de verkoper niet kan aantonen dat de vergoeding door de fabrikant of de importeur betaald is, is hij verplicht tot betaling daarvan aan de in artikel 16d, eerste lid, bedoelde rechtspersoon, tenzij uit de in het eerste lid genoemde bescheiden blijkt wie de fabrikant of de importeur is.
