With regard to the person whose liberty was already lawfully deprived on the day preceding the entry into force of Article 8b, the day of the entry into force of Article 8b shall be regarded as the first day on which the deprivation of liberty takes place for the application of that Article, and, by way of derogation from Article 8b, paragraph 2, the right to an old-age pension shall end from the day that this deprivation of liberty has lasted for six months. The termination shall take effect on the first day of the month following the month in which the deprivation of liberty as referred to in the first sentence has lasted for six months.
Ten aanzien van de persoon wiens vrijheid op de dag voorafgaande aan de inwerkingtreding van artikel 8b reeds rechtens was ontnomen wordt voor de toepassing van dat artikel als eerste dag waarop de vrijheidsontneming plaatsvindt, aangemerkt de dag van inwerkingtreding van artikel 8b en eindigt het recht op ouderdomspensioen in afwijking van artikel 8b, tweede lid, vanaf de dag dat deze vrijheidsontneming zes maanden heeft geduurd. De beëindiging gaat in op de eerste dag van de maand volgend op de maand waarin de vrijheidsontneming als bedoeld in de eerste zin zes maanden heeft geduurd.
