The pension beneficiary who entered into a marriage before 1 January 2015 and who, prior to that date, is entitled to an old-age pension, and whose spouse is younger than the pensionable age, shall be entitled to a supplement in accordance with the provisions of this Act, unless, with due observance of Article 11, the income from employment or other income of that spouse exceeds the full gross supplement.

2.

By way of derogation from the first paragraph, no right to an allowance shall arise on or after 1 January 2015 as a result of:

a.

change of income, as referred to in the first paragraph;

b.

a change in the form of cohabitation, as a result of which the person is no longer an unmarried person as referred to in Article 1, paragraphs 2 and 3;

c.

taking up residence in the Netherlands or in a country with which a treaty has entered into force or a decision of an international organisation has become effective, on the basis of which a right to an allowance may exist;

d.

a release as referred to in Article 8b, paragraph 3; or

e.

no longer evading the enforcement of a custodial sentence or a measure involving deprivation of liberty as referred to in Article 8c, paragraph 3;

f.

the cessation of the well-founded suspicion that the pension beneficiary or their partner is located outside the Netherlands for the purpose of joining an organisation as referred to in Article 1, paragraph 1, point l.

If the entitlement to an allowance has terminated solely as a result of an incidental increase in income, as referred to in the first paragraph, the entitlement to an allowance may, by way of derogation from the second paragraph, be revived.

Where this Act and the decrees enacted for its implementation refer to old-age pension, this shall also include the supplement referred to in the first paragraph, unless provided otherwise.

De pensioengerechtigde die voor 1 januari 2015 is gehuwd en voor die datum recht heeft op ouderdomspensioen en van wie de echtgenoot jonger is dan de pensioengerechtigde leeftijd, heeft overeenkomstig de bepalingen van deze wet recht op een toeslag, tenzij, met inachtneming van artikel 11, het inkomen uit arbeid of overig inkomen van die echtgenoot meer bedraagt dan de volledige bruto-toeslag.

In afwijking van het eerste lid ontstaat op of na 1 januari 2015, geen recht meer op toeslag als gevolg van:

a.

wijziging van het inkomen, bedoeld in het eerste lid;

b.

wijziging van de leefvorm, waardoor niet langer sprake is van een ongehuwde als bedoeld in artikel 1, tweede en derde lid;

c.

het gaan wonen in Nederland of in een land waarmee een verdrag in werking is getreden dan wel een besluit van een volkenrechtelijke organisatie van kracht is geworden, op grond waarvan recht op toeslag kan bestaan;

d.

een invrijheidstelling als bedoeld in artikel 8b, derde lid; of

e.

het zich niet langer onttrekken aan de tenuitvoerlegging van een vrijheidsstraf of vrijheidsbenemende maatregel als bedoeld in artikel 8c, derde lid;

f.

het niet langer bestaan van het gegronde vermoeden dat de pensioengerechtigde dan wel diens partner zich buiten Nederland bevindt met het doel zich aan te sluiten bij een organisatie als bedoeld in artikel 1, eerste lid, onderdeel l.

Indien het recht op toeslag is geëindigd uitsluitend als gevolg van een incidentele stijging van het inkomen, bedoeld in het eerste lid, kan, in afwijking van het tweede lid, het recht op toeslag herleven.

4.

Waar in deze wet en in de tot haar uitvoering genomen besluiten wordt gesproken van ouderdomspensioen wordt daaronder mede verstaan de in het eerste lid bedoelde toeslag, voor zover niet anders is bepaald.
